Happy Thursday everyone! I had a discussion a colleague the other day about the difference between the entrepreneurship and ownership mentality. While there is nothing wrong with either, I work with my clients to ensure that they are more than entrepreneurs, they are true business owners.

While the two terms are often used interchangeably they create two distinct images in the minds of your consumers:

✨While an entrepreneur may dabble in multiple business ventures, a business owner has a clear vision and focus on the sustainability and profitability of their business. They may run multiple businesses, but take steps to ensure that their businesses are set up on a legally sound foundation.

✨ An entrepreneur is focused on innovation and taking risks, while a business owner is focused on building their brand and TRULY owning their brand and content. (Pssstt, owning your brand is more than slapping a name on a label. You must take additional steps to register your brand AND protect it from infringers)

✨ While an entrepreneur may focus on the profitability of their many business ventures, a Business Owner is focused on building a legally sound and sustainable process of each company. They build a sound team of professionals around them that includes a business lawyer and a CPA to ensure that their business grows separate and apart from themselves.

No matter what you consider yourself, I just want to encourage you to keep pushing! You’ve got this! Business ownership is not easy. Surround yourself with a supportive team that can help you grow and just work on making each day better than the last.

Beyonce's Birkin's may be "in Storage", the owners of Hermes may be breaking out their Birkin bags in celebration after winning its suit against Mason Rothschild. The new york jury awarded Hermes $133,000 and found that Rothchild's NFT's were a violation of Hermes' registered trademark for its signature birkin and was not protected by the 1st ammendment as artistic expression. Several similar suits are pending around the country for brands from Nike to Gucci. Should be interesting.

Luxury brand Hermès International SA won its lawsuit against the digital artist behind “MetaBirkin” nonfungible tokens after convincing a Manhattan federal jury that Mason Rothschild’s sale of the NFTs violated Hermès’ rights to the “Birkin” trademark.

Another year around the sun, another year full of blessings. Thank you to all of those who have added such richness to my life thus far. This past year was a year of sowing seeds. God has continuously kept his arms wrapped tightly around me and my business in protection. He has guided each and every step in my personal and business life. Man… starting a law firm is not for the faint of heart. But it has been the most rewarding yet challenging experience thus far. 💛

One thing about my God, he has continuously made a way to provide. He has allowed me to use my years of experience in this field to meet some AMAZING entrepreneurs and CEOs and I am so grateful! ☺️

More than anything, he has put me in a position to grow this thing into something I can’t even imagine at this point. I genuinely love working with my clients from GA 🍑 to the West 🏞 I just love what God is doing in my life.

Did you know that registering your Trademark is only the first step to protecting your brand? 🤔 Federal Trademarks must be maintained to ensure that the trademark registration isn't cancelled, requiring a new trademark application. Maintaining your trademark includes:

⚜️Trademark Watch/Monitoring: Once you register your trademark it is YOUR duty to monitor your mark & enforce your rights. Unless you retained a for all of your IP needs, no one is monitoring the USPTO for new trademark applications or monitoring state trademark & business filing databases or social media for individuals using similar marks. Failing to monitor the mark & enforce your rights will result in weakening your trademark & losing your marks distinctiveness.

⚜️Declaration of use filing after 5 years: Between the 5th & 6th year of your trademark registration you must file this declaration stating that your trademark is still used in commerce. If you miss this deadline, your mark will be cancelled and you will have to start the registration process all over again 😬.

⚜️ Declaration of Incontestability After 5 Years (Optional, but a great option for certain marks): This designation gives your mark the presumption of validity and carries great weight in court.

⚜️ Declaration of Use & Application for Renewal 9 years after Registration & every 10 Years after that: If you do not file this application of Renewal, the USPTO will cancel your mark.

I'll Leave you with These Keys for Success:

🔑 Trademark Registration is only the beginning. You must maintain your mark & enforce your rights against infringers. Make sure you know the timeline for filing each renewal & declaration, keep a comprehensive cease & desist letter on hand, & have a that is ready file suit.

🔑 Give your intellectual property the same care & attention that you give your Real Property. You have to maintain it or it will be WORTHLESS.

Greetings Beautiful People! This past year has brought so many changes for so many people, myself included.
