Whether you see a security system or not, always ask your Seller if they have a surveillance system. If so, disclose the use of all surveillance devices. Consider posting a sign that states that the property has an audio and/or video surveillance system in use as a risk management practice.

Utilize a written document which requires indemnification for any unlawful surveillance by the Seller. Additionally, include in the MLS comments that a surveillance system is in use. If the Seller does not think it is legally necessary, let them know that complicated laws govern audio and video recordings. Providing this information also protects the safety of the homeowner and their property.

🏡Closing Insight 💡 The response is valid. “Delivery” is a defined term and the answer to the question is found in the Delivery Paragraph (6) itself. Assuming we are talking about an email transmission, Delivery is considered accomplished/or deemed to have occurred when sent by email, when there is a tangible record of the transmission (i.e. when the agent can show via their sent mail time stamp that it was sent prior to any deadline). This is to prevent parties to a contract from refusing Delivery or avoiding it, purposefully, beyond the expiration of a deadline, a behavior the contract also prohibits expressly. The same concept exists for let’s say hand delivery or paper mail. They are considered delivered not when received (or picked up from the mail or a drop box), but when actually delivered to a destination that is specified in the contract for delivery.

The Seller can be the Estate and the contract signed by the Executor if there is a Will which gives him/her powers of sale and he/she qualifies in Probate Court or it can be signed by the Devisees under a probated Will.

If there is no Will, the Heirs at Law, as established by a Real Estate Affidavit filed in the Circuit Court where the property is located, can sign the Contract. If there is an Administrator appointed by the Court with the power to sell real property, then the Administrator can sign the contract.

As a real estate agent it is important to be aware of these menacing advertisements and know what has prompted these concerns.

Title Lock insurance commercials are prevalent on television and the radio. However, title lock insurance, does not “lock” your title nor “insure” you against any fraud. At best, the service offered simply informs you that your title has been “stolen” after the fact.

Due to the intimidating nature of these advertisements, the MD Attorney General sent out a Consumer Alert (https://www.marylandattorneygeneral.gov/press/2022/062722CA.pdf).

The Attorney General concluded “[t]he bottom line is: You don’t need to purchase title lock insurance.” As noted in the release, title lock insurance is separate and distinct from title insurance. The MD AG distinguished the two products and noted that that title insurance provides valuable protection to real estate purchasers and lenders from potential losses.

This question provides a wonderful opportunity for you to market yourself and your business acumen if you advised your client to purchase an enhanced title insurance policy. The title policy they have in place provides coverage for the exact type of fraud which is warned of in the commercials!

It is a matter of preference and sometimes the decision is situational (case by case), but there are some practical and legal implications to take into consideration. When you name only yourself (as the agent), you take on the burden and risk of liability in a situation where an email containing a notice escapes you, or you don’t forward it to your client in time to discuss/address/respond in a timely manner. Remember, if you specify yourself for Delivery, then Delivery to you EQUALS Delivery to your client, and all timeframes start to run.

Example: Let’s say a notice is sent to you with requests for repairs under a home inspection contingency. It goes into your spam, or you are on vacation, and you do not see it. You then notice it in your spam, but not until after the negotiation period has expired, making it impossible for your client to respond timely. The buyers are now in their election period and they decide to void the contract due to your client’s lack of response. If the seller were to seek legal recourse for the contract fall through,
liability could become yours given you were the responsible party for receiving the notice.

Alternatively, naming only your client makes it such that you do not see notices until after your client has, which may not be a good way of managing their reactions, delivery of information, and the transaction. However, if you had named you and your client, responsibility is shared and it lessens the liability to the agent in the event a response isn’t timely, but it also ensures you see notices at the same time as your client.
