DWI Test Results Thrown Out by Judge!

Great result for client makes for a good day.

My client was arrested in Hennepin County for suspected hit and run. After arrest the police decided my client had been drinking, took him downtown, and asked him to submit to a urine test. While reading my client the Implied Consent Advisory, the po ...

Liberty and privacy protected! The United States Supreme Court issued a unanimous ruling recently that requires the government to obtain a search warrant before installing any sort of GPS tracking device on your vehicle. This may not seem like much, but allowing law enforcement to simply track the whereabouts of whomever they pleased, without first having to obtain a warrant based on probable cause to believe a crime is actually being committed, would be a slippery slope to a complete loss of privacy.

For the most part, judges try hard to get it right. I really believe that. I also believe everybody is entitled to make a mistake or two along the way. However, those mistakes are really hard to swallow when a brand new judge gets the law completely wrong, and forces my client to endure greater heartache and financial stress in trying to make it right. Divorce and custody disputes are hard enough, even when the judge gets the law right.

Attention commercial motor vehicle drivers. A federal court judge recently ordered the Minnesota State Patrol (MSP) to reverse all determinations that drivers were impaired due to fatigue between April 1, 2008 and September 30, 2010, and they are to notify every driver who received such a determination during that time frame that it has been reversed. Basically, the judge found that the MSP's guidelines for determining whether a driver was actually impaired by fatigue were too vague and open to too much interpretation.

Legal tabloid news of the day. Ever wonder how much your local news celebrities earn? Well, local news anchor / radio host Jeff Passolt recently divorced his wife of 30 years, and the Court of Appeals opinion states his gross annual income is approximately $525,000.

The DWI laws in Minnesota were recently changed so that you can now apply to have a b-card restriction removed from your driver's license. Give me a call at (507) 964-2992 if you would like more information regarding this change.

Finally, my web page is up and running! In the near future you should again start seeing blog posts from me on various legal topics. Drop a line with any special requests.

Successfully defended my client against the issuance of an Order for Protection today. It is a good day when justice prevails.

Dear Readers. For the next few months I am going to shift my focus from family law to criminal law. However, I am always open to suggestion and invite each of you to submit topics of interest confidentially via e-mail. In the mean time, enjoy and I hope to hear from you soon. Carol

Well, the blizzard shut down Arli-Dazzle and it will not be rescheduled. Please stop by the office any time for a cup of the hot chocolate we had planned on serving to frozen spectators.

The Mayer Law Office plans on serving hot chocolate and warm greetings during the 2nd annual Arli-Dazzle parade on December 11, 2010, in Arlington, Minnesota. The parade starts at 5:30 p.m. and is sure to warm your hearts with holiday cheer!

I was visiting with a very nice lady at a fundraising event when she asked my name. Upon hearing my reply she exclaimed...."Oh, you're the lawyer's wife!" What a lucky husband I have, he didn't even have to take the bar exam.

My heartfelt congratulations go out to John Dehen, newly elected judge in the 10th judicial district, and Mark Metz, newly elected Carver County Attorney! Both are fine, upstanding individuals who will certainly do justice to their hard won positions.

Why is it that all professional athletes cannot project the class act that Alan Page projects?

Although my business is the practice of law, my clients are more than just business.

Although my buisness is the practice of law, my clients are more than just business.

The sun is shining in Arlington, and I'm off to the Sibley County Recorder's Office where I will bury myself in ancient real estate records. Wish I could save it for a rainy day.
