The idea that approvals can be reversed at any time, with no explanation, is chilling for borrowers. Mr. Rudert, who graduated from law school owing nearly $135,000 on student loans, said he would have picked a different employer if he had known that his work at Vietnam Veterans of America would not qualify.

Over 550,000 people have applied to have their student loans forgiven, and thousands of approval letters have been sent. But they might be wrong.

I have more than one disabled client suffering garnishment of their SSDI benefits due to defaulted federal student loans. Right now there is a way to rehabilitate those loans and stop the garnishment and end the default for as little as $5/month (based on income).

Student loan debt isn’t just a problem for young people. More than 700,000 households led by someone 65 or older have student loan debt – and the Treasury Department will actually take money out of people’s Social Security checks to pay back these student loans.

Last year, Senator Claire McCaskill and I asked the Government Accountability Office—the federal government’s watchdog—to investigate this garnishment program, and today GAO reported their findings. The government has collected $1.1 billion from the Social Security checks of seniors and Americans with disabilities to pay for student loans, and 71% of that money isn’t even paying down the debt – it’s just going to fees and interest. That means the federal government is boosting its student loan profits while shoving tens of thousands of Americans who depend on Social Security to make ends meet deeper into poverty. No wonder many Americans don’t think Washington works for them.

The GAO report is clear: Social Security garnishment for student loans is predatory and counterproductive. Congress should pass the Benefits Restoration Act – a bill I’m cosponsoring – to put a stop to it.

I am hoping these speculated changes will not all come to fruition under the incoming "administration".

Seriously, filing a pro se bankruptcy is inviting even further financial disaster than you may already be facing. Don't find yourself in the position of losing assets (some of which you may not even know you had) or worse in order to avoid paying a lawyer. Not a mere handful, or a couple of dozen, but more than 100 untimely cases over the course of just two years were shunted along through the investigative process, at no small cost to the respondents, very often small business owners with paper-thin margins. And it seems unlikely that this was an aberration. After all, there is no reason to think that suddenly, in the summer of 2012, the MCAD started accepting late-filed cases.
