One of the most common questions when filing for bankruptcy is how the bankruptcy will affect credit scores.

While bankruptcies can have an impact on credit score for years, in reality this impact is often not as severe as people think. The longer it's been since the bankruptcy, the less the impact it will have. Often, when filing for bankruptcy, the credit score is already low and will likely increase when the debt is taken care of.

Unfortunately, Attorney Conley was out of office for several days due to a funeral and then had to get caught up with other work, so our posts have been delayed. But this provides for an excellent opportunity to discuss how bankruptcy affects inheritance.

If you are set to receive inheritance and the time of filing, or someone dies within six months after you file and you will receive something from them, that inheritance must be disclosed. Often times there are exemptions that a quality bankruptcy attorney can identify to protect the inheritance.

The worst thing that you can do is to not disclose it. Attorney Conley had a case where roughly $50,000 in inheritance value was not disclosed and the client was denied a discharge because of their non-disclosure. It is always better to disclose.

One of the most annoying aspects of being in debt is the constant phone calls, emails, and letters from creditors trying to collect on the debts. Here at Owings Law, we are empathetic to your situation, and we want to help you.

When you retain us to file your bankruptcy, you are immediately protected from creditor contact. You will need to let them know that you have retained us to file your bankruptcy and that all contact should be sent to us. If they continue to contact you, let us know.

Once you have filed for bankruptcy, the creditors are prohibited from contacting you due to federal law. If they still contact you, let us know and we may be able to get you damages for the contact.

Once you have been discharged, you no longer owe that debt and the creditors will stop contacting you. If they still do let us know. This is extremely rare though.

Evictions are both scary and happen quickly. Here at Owings Law, we are empathetic to your situation and we want to help you.

If you are facing an eviction, we can file a Chapter 13 to allow you to stay in unit for longer. We will have you pay the ongoing rental payment and the past due rent inside the plan. So, at the end of the Plan, you will be completely caught up on your rent.

We can also file a Chapter 7 to temporarily prevent an eviction. The Chapter 7 will erase the past due rent that you owe, but it won't prevent the landlord from ever evicting you. But the temporary prevention may allow you to work something out with the landlord, or to move into a new place.

A garnishment can be devastating, especially when you are already struggling. Here at Owings Law, we are empathetic to your situation, and we want to help.

We can stop your garnishment when you file for bankruptcy. Depending on the timing, you may still have your next check after filing garnished if your employer had already processed payroll by the time you filed. But any amount garnished after you file will be returned to you.

It is possible we may decide to wait to file when you are being garnished. This is because if you had more than $600 garnished within the 90 days before filing, it is possible to get that money back. So, if you need one more check to be garnished to put you over the $600 threshold, we may wait so you can get some money back. One of the most confusing aspects of bankruptcy is the automatic stay.

Many people are confused on what this is and how it works.

Firstly, the automatic stay starts as soon as the bankruptcy case is filed. There is generally no need to file anything to initiate the stay. An exemption applies when a debtor has filed multiple Chapter 13 cases within the same year. And then the debtor needs to show why the second case will succeed. Here at Owings Law, we will prepare you for this.

The automatic stay prevents creditors from trying to collect on debts that you owe them. So, garnishments, foreclosure actions, and repossessions will stop. The automatic stay even stops divorce actions.

If a creditor violates the automatic stay, they potentially are liable to you for damages. Owings Law can help you with these actions as well.

Because of the potential damages, creditors are weary of violating the automatic stay. Because of that, creditors will usually turn off online access and automatic payments. This is usually only an issue for mortgage and car loan accounts that you want to maintain. If this happens, you will need to figure out how to make the payment(s). You can generally do this by calling in, mailing the payment, a wire transfer, or directly from your bank account.

The bankruptcy process is pretty quick and simple as long as you cooperate. The process involves providing documentation to your attorney including items such as your ID, social security card, and pay stubs. You will need to meet with your attorney to review the Petition and verify that everything is correct. You will need to meet with the assigned Trustee over Zoom where you will answer some questions about your Petition and situation. It is possible that you will then need to provide more documentation at this point.

In a Chapter 13 there may be changes that need to be made to your Plan, and you will likely need to provide your tax returns during the life of your Plan.
