On 30th March 2020, the office of the Commissioner for Labour, Industrial Relations and Productivity, directed all employers to submit returns setting out particulars concerning number of employees, monthly salaries of the employees, national identification numbers and other conditions affecting the employment of all employees who have or are likely to be affected by the COVID-19 pandemic either through email: [email protected] or to the physical offices of the Commissioner Labour, Industrial Relations.
Our team has reviewed the relevant provisions of the Employment Act and advise that the office of the Commissioner is acting within its power to make such a request. Non compliance of such a directive may attract criminal sanctions, which carry either or both fines and short prison.
