Last week, Voices For Labour along with other organisations filed two petitions in the Constitutional court of Uganda challenging the exclusion of workers in the informal economy from protection.

The first Petition seeks to challenge some provisions of the Labour Unions Act, No.7 of 2006, Employment Act No.6 of 2006, The Labour( Dispute settlement and arbitration) Act and the Workers compensation Act, 2000 whereas the second one challenges the eviction of street vendors including some provisions of the law that deny them protection contrary to what the Constitution of the Republic of Uganda provides.

‼️The process has been flagged off by International Lawyers Assisting Workers Network and Voice for Labor in Uganda.
‼️ Mwijuka Jesca has been a stakeholder since the process started in 2021 and is head of the Social Media Campaign Strategic Team.

THE POSITION OF THE LAW ON CONSTRUCTIVE DISMISSAL

In UGAFODE Microfinance Ltd VS Mark Kyoribona Labour Dispute Appeal NO. 034 of 2019 [Arising from Labour Dispute Complaint No. 241/2018, The Industrial Court of Uganda re-affirmed the position of the law on constructive dismissal. Court quoted this;

Section 65 of the Employment Act provides;
“65. Termination
Termination shall be deemed to take place in the following circumstances –
…..
….
Where the contract of service is ended by the employee with or without notice, as a consequence of unreasonable conduct on the part of the employer towards the employee; and
…”

Unreasonable conduct of the employee can only be ascertained from the circumstances of a given case. Such unreasonable conduct may lead the employee to offer resignation or refusal to report to work thus terminating the employment relationship.

Court refered to its own decision in the case of Nyakabwa J. Abwooli Vs Security 2000 Ltd, Labour Dispute 108/2014 where it held;

“In order for the conduct of an employer to be deemed unreasonable within the meaning of Section 65 (1)(c) … such conduct must be illegal, injurious to the employee and make it impossible for the employee to continue working. The conduct of the employer must amount to a serious breach and not a minor or trivial incident and the employee must act in response to the breach not for any other connected reason and act in a reasonable time. What might be a serious breach in one case may not be necessarily a major one in another case and so each case must be decided on its particular facts.”

Reference was also made to the the authority of Muyimbwa Paul Vs Ndejje University, Labour Dispute Reference No. 222/2015 which held that demotion of an employee without a hearing is a serious breach of contract constituting constructive dismissal once an employee refuses to return to work as a result of such demotion.

Workers should normalize the habit of making written requests for annual leave. Many companies do not provide employees with leave request forms. However, in such circumstances, employees can make a written request to prove that they requested for the same and were denied.It is important that they do this because many are losing out on claims of unpaid leave on the basis of failing to prove that they requested and were denied the same.

More than 2 billion workers make up the informal economy

"Informal employment refers to the very large labor force that falls outside of protective labor laws, outside of different forms of social protection and really outside of access to justice," says Dr. Sally Roever, International Coordinator of the global research and policy network Women in Informal Employment: Globalizing and Organizing (WIEGO). "The majority of workers in the informal economy are trying to make a living against great odds," she adds.

The informal economy employs 6 out of every 10 workers in the world—and the economic recovery of these workers is a critical component of a global economic rebound from the Covid-19 crisis.
