WHAT MUST YOU KNOW WHEN A HOSPITAL DETAINS THE BODY OF A DECEASED RELATIVE UPON FAILURE TO PAY THE BILL
Due the spiralling covid cases, admission of patients in the ICU of various hospitals has increased. Unfortunately after hundreds of millions spent, the patient succumbs to the disease, sadly leaving a very high treatment bill unpaid. As a means of recovery, hospitals have denied to release the deceased bodies to the families until the bill is settled. But......
WHAT MUST YOU KNOW:
1. Bill must be reasonable in light of Section 24 of the Medical and Dental Practitioners Act
2. Appreciate the terms of the treatment contract esp the rates, variances in treatment and how the variations affect the final bill.
3. Only pay for what is administered to the patient. Most invoices have a list unascertainable notes often ignored.
4. It is illegal for a hospital to detain the deceased's body as any debt can be settled by the estate of the late.
WHAT DO YOU DO IF YOU ARE VICTIM
1. Seek legal redress.

WHAT MUST YOU KNOW WHEN YOU ARE LIABLE OR A VICTIM OF CYBER HARASSMENT
The Constitution permits freedom of expression but the same Constitution restricts enjoyment of such rights where such enjoyment infringes on the rights of others. The law has criminalised "OFFENSIVE COMMUNICATION"
Section 25 of the Computer Misuse Act, 2011 provides that “any person who willfully and repeatedly uses communication to disturb or attempts to disturb the peace, quiet or right of privacy of any person with no purpose of legitimate communication whether or not a conversation ensues commits a misdemeanor.
HOW DO YOU KNOW COMMUNICATION IS OFFENSIVE:
1. If it is made without a legitimate purpose. Mostly if it is false or made with malice like false news, insults, defamatory statements etc
2. If it is made repeatedly and stubbornly.
3. Such communication disturbs or disturbs the peace of another.
WHAT DO YOU DO IF YOU ARE VICTIM
1. Seek legal redress. (Do not issue similar insults)
HOW DO YOU AVOID LIABILITY
1. Desist from disseminating false and malicious information on any social media.
2. Verify the truth basis and legitimacy of the information, if you are not sure, don't publicise.
3. Be mindful of your account and user details. Avoid leaving your account logged on in cafes etc

WHAT MUST YOU KNOW WHEN YOU ARE VICTIM OF HARASSMENT AT THE HANDS OF SECURITY OPERATIVES
The Constitution provides that no person shall be subjected to torture or cruel, inhuman or degrading treatment or punishment. The Prevention and Prohibition of Torture Act and the Human Rights Enforcement Act criminalise such conduct undermining the dignity of an individual.
WHAT MUST YOU KNOW
1. It is ILLEGAL for you to be subjected to any form of physical or psychological harassment / torture
2. It is an OFFENCE and the perpetrator is liable to prosecution before a court of law or the police or army Disciplinary tribunal.
3. You are ENTITLED to COMPENSATION for any injury sustained.
4. In case you have been arrested, the CHARGES against you must be DISCONTINUED
5. Anything you may have said as a result of such harassment is not ADMISSIBLE in COURT.
WHAT MUST YOU DO
1. IDENTIFY the INDIVIDUAL or institutional perpetrators. Note the names, ranks, station, division, force number, to
enable you subsequently describe the person.
2. SECURE PHYSICAL EVIDENCE of the torture or harassment ie photographs, medical reports etc
3. If you have been charged on another offence, the PROSECUTION must be DISCONTINUED.
4. No CONFESSION stemming from the torture should be ADMITTED in COURT.
