#มรดก คือ ทรัพย์สินของผู้ตาย หากใครยังไม่ตายทรัพย์สิบนั้นก็ไม่ใช่มรดก ไดยตามปกติ ผู้เป็นเจ้าของทรัพย์สินสามารถที่จะจัดการทรัพย์สินของตัวเองอย่างไรก็ได้ ด้วยการทำพินัยกรรม
#พินัยกรรม คือ การแสดงเจตนาของผู้ตายในเรื่องเกี่ยวกับทรัพย์สินและกิจการ ของตนก่อนตายเพื่อให้การแสดงเจตนากำหนดการเผื่อตายไว้ถ่วงหน้านั้นมีผลต่อเมื่อตนถึงแก่ความตายแล้ว ซึ่งการแสดงเจตนาดังกล่าวต้องได้ทำตามแบบที่กฎหมายกำหนดไว้
#ผู้รับมรดก เป็นใครเมื่อมีคนตายและผู้ตายมีทรัพย์สิน ซึ่งทรัพย์สินนี้ก็จะกลายเป็นมรดกตกทอดไปยังทายาทของผู้ตายโดยทันที ซึ่งมรดกของผู้ตายจะตกทอดไปยังทายาทตามที่กฎหมายได้กำหนดไว้ให้ทายาทผู้มีสิทธิรับมรดก 2 ประเภท ได้แก่
1. ทายาทโดยธรรมของผู้ตาย
2. ผู้รับพินัยกรรม
#คู่สมรส ตามกฎหมายย่อมมีสิทธิได้รับมรดกก่อนทายาทโดยธรรมเสมอ
