DEPORTATION STOPPED AT THE LAST MOMENT

A family facing a final removal decision had already arranged their departure from Sweden.

Following important new developments, new residence permit applications were submitted, and our Jurist, Rashid Mehmood, requested inhibition of enforcement.

Shortly before the family’s planned departure, the Swedish Migration Agency granted inhibition and suspended the enforcement of the expulsion decision until further notice.

The family can now remain in Sweden while their new residence permit applications are being processed.

This case shows the importance of carefully assessing new circumstances and available legal remedies, even where there is already a final removal decision. Every migration case is different and must be assessed on its individual circumstances.

Important update for young adults who turn 18 while living in Sweden on a family-based residence permit. From 1 October 2026, new rules under Sweden’s national family reunification framework may allow certain young adults aged 18 to under 21 to continue their residence based on family ties.

The reform also introduces, for some former child dependants, a temporary possibility to apply from within Sweden on another qualifying basis, such as work, higher education, another family relationship, or an EU Blue Card.

Sweden’s New Family Reunification Rules: What Changes from 1 October 2026?

Sweden is introducing significant changes to its family reunification rules, with the principal legislative changes entering into force on 1 October 2026.

To make these changes easier to understand, we have prepared a 17-part information series explaining the most important aspects of the reform and what they may mean in practice.

The series covers the new two-year residence requirement and its exceptions, stricter and expanded maintenance requirements, rules affecting extensions, special provisions for young adults, workers, researchers, EU Blue Card and ICT families, health insurance requirements, protection against violence and serious abuse, DNA evidence, and the important transitional rules for applications submitted before 1 October 2026.

One point is particularly important: the new rules do not affect every family in the same way. For example, holding a temporary residence permit does not automatically mean that family members must wait two years. The applicable legal provision, the sponsor’s residence status, the family relationship, possible exceptions, maintenance requirements, and the timing of the application must all be considered.
