Can you open a company in Poland without renting an office? 🇵🇱

In many cases — yes.

A company in Poland must have a registered legal address, but this does not always mean renting a physical office.

Common solutions include:
• virtual office services
• coworking spaces
• business service addresses

The right setup depends on:
👉 your business activity
👉 residence status
👉 operational needs

Choosing the wrong structure may lead to administrative or tax issues later.

Professional setup matters from the beginning.

Company loss in Poland?

A loss does not trigger immediate taxation.
In a Polish sp. z o.o., it may be carried forward and used against future profits.

However, the framework is strictly regulated:
• losses may be carried forward for up to 5 years
• annual deduction is limited to 50%
• a one-off deduction of up to 5M PLN may apply
• proper accounting treatment is essential

Mismanagement of losses leads to irreversible tax inefficiencies.

If your company operates at a loss or you are planning your tax position — precision matters.

Running a limited company (Sp. z o.o.) in Poland comes with responsibilities many business owners underestimate.

Full accounting means:
✔ every transaction must be recorded
✔ monthly tax obligations must be fulfilled
✔ your company must report financial activity regularly

It’s not just about having an accountant, it’s about making sure everything is actually done correctly and on time.

💡 A simple rule:
Ask your accountant for monthly confirmation of filings.

This small habit can save you from serious problems.

Deposit (zadatek) and advance payment (zaliczka) are not the same in Polish law.

An advance payment (zaliczka) is a prepayment —
it is generally refundable if the contract is not completed.

A deposit (zadatek) has a different function.
It secures the contract.

If one party withdraws — the deposit may be lost.
If the other party withdraws — it may be returned in double.

That’s why it’s important to clearly identify
whether you are paying a zaliczka or a zadatek.

This difference can have real financial consequences.

Save this for future reference.

Running a business in Poland means dealing with:
• contracts
• taxes
• social security (ZUS)
• compliance obligations

These elements are connected.

Choosing the wrong contract, setting the wrong structure, or misunderstanding obligations —
can lead to higher costs or legal issues.

This is why structure matters from the beginning.

If you are hiring, opening a company or already operating in Poland — make sure your setup is correct.

How much tax do companies pay in Poland?

Companies operating as a sp. z o.o. (Limited Liability Company) are subject to Corporate Income Tax (CIT).

The main rates are:
• 19% — standard rate
• 9% — reduced rate for smaller companies

The applicable rate depends on the company’s revenue and status.

However, corporate taxation is not only about the CIT rate.

It also depends on:
• how profits are distributed
• the structure of the company
• the form of remuneration

Hiring foreigners in Poland can be a great opportunity, but only if you follow the legal requirements.

Many employers unknowingly make mistakes that can lead to:
❌ fines
❌ problems during inspections
❌ issues with legalization of stay

Here are 3 of the most common ones:
1️⃣ Assuming a residence card = right to work
2️⃣ Starting employment before the work permit is valid
3️⃣ Mismatch between the work permit and the employment contract

These mistakes are more common than you think and they can cost your business a lot.

💡 If you’re planning to hire foreigners in Poland, make sure everything is fully compliant.
