Some decisions come with a deep breath of relief!

This has been the longest case I've ever handled.

It started simply. The application was submitted in July 2023, based on graduation, with the intention of looking for a job. Unfortunately, nothing after that was simple anymore.

First, there was an issue with the bank statement, and in July 2024, the first negative decision was issued. But it was a mistake because, 5 weeks earlier, we had submitted a request to change the main purpose of stay, together with a full set of documents proving that my client had already found a job.

We appealed.

The Office for Foreigners accepted our appeal but had to send the case back to the first-instance authority because they had failed to consider the correct documents.

Once the case was returned, we started another chapter of this journey. We updated the documents once again... and then again... and, in fact, several more times.

Finally, in March 2026, another decision was issued. Negative. Again.

Why? Because, according to the Voivodeship Office, the employer did not have sufficient financial resources to pay its employees. My client had never complained about not receiving his salary, and according to him, neither had his colleagues. But apparently, the Voivodeship Office knew better. 😉

So we appealed again.

This time, within two months, we were asked to provide additional documentation—but only regarding the employer's financial situation: ZUS confirmations, tax documents, and financial reports.

Unfortunately, the employer did not take the request seriously enough, and after 3 years of waiting, there was a very real threat of receiving a final negative decision.

A few phone calls and a few emails later, we finally received all the required documents, and the Office for Foreigners was kind enough to wait for them, even though we were unable to meet the original deadline.

Today, we received a positive decision. What a relief!

Most importantly, my client can finally start looking for a better job. As expected, no serious employer was interested in hiring someone whose previous temporary residence permit had expired three years ago.

Two lessons from this case:

1. Immigration authorities are not infallible. They can make mistakes. They shouldn't—but they do.

2. Your legal future in Poland depends not only on you but also on your employer. Choose your employer wisely. If possible, check whether other employees receive their documents on time and obtain their residence permits without unnecessary problems. You may do everything correctly and still receive a negative decision—or spend years stuck in a low-paid job, unsure whether you'll ever have the chance to move on.

If your residence permit case is delayed, unclear, or has ended with a negative decision, do not wait too long to ask for help.

At BL Consultancy, we help foreigners understand their options and take the next right step.

Warm regards,
Beata

⚠️Before PIP checks your documents, check them first.⚠️

Employers in Poland have until 8 July 2026 to prepare for an important shift in labour law enforcement. The upcoming PIP reform is not only about contracts. It is about whether your company can prove that its employment documentation is complete, consistent, and aligned with the real way work is performed.

For companies employing foreigners, this is especially important.

A proper review should go beyond a standard HR file check.
It should also confirm whether each foreign employee has the correct right to work, whether the contract matches the work authorisation basis, whether the job title and duties are consistent, whether ZUS and tax data match the employment documents, whether Annex 1 and residence permit documents are accurate, and whether student or graduate work rights have been correctly assessed.

This matters even more if your company works with foreign students, recent graduates, B2B contractors, outsourced workers, or employees whose residence permit depends on employment.

Small inconsistencies can become much bigger problems when different institutions compare information or when documentation is reviewed remotely. A contract may say one thing, ZUS records another, Annex 1 something slightly different, and the actual working arrangement may tell a fourth story.

That is exactly where compliance risk begins.

At BL Consultancy, we help employers identify these risks before they become urgent. Our employer compliance support can include foreign employee file reviews, work-right verification, documentation checks, HR guidance, and practical recommendations for improving internal processes.

If your company employs foreigners in Poland, do not wait for an inspection to find out whether your documents are ready.

Parts of Europe are facing extreme heat, with temperatures already exceeding 40°C in some countries and records being broken or threatened across the region. Poland may also come close to its historic heat record of 40.2°C, set in Prószków in 1921.

For many internationals in Poland, this kind of heat can feel especially intense, so please do not underestimate it.

🎓A student recently asked us: “But I am a student in Poland, so I can work without a work permit, right?”

This is one of the most common misunderstandings among international students in Poland. The answer is not always as simple as many people expect, and from 1 July 2026, it will become even more important to understand the difference.

Student status alone does not always mean full access to the Polish labour market. In practice, your right to work may depend on whether you are studying full-time, part-time, or on weekends, whether your university is public or private, whether your private university remains on the government’s approved list, and whether you are still studying or have already graduated from a university located in Poland.

This matters for students because a mistake can affect legal employment, residence permit planning, and future applications. It also matters for employers because hiring a foreign student without checking their actual right to work can create unnecessary compliance risk.

The safest first step is simple: before you accept a job, continue working, or hire an international student, check the legal basis carefully. This includes checking the official lists of universities that are authorised to admit foreigners to begin or continue their studies in Poland, especially if the student studies at a private university.

At BL Consultancy, we help international students and employers understand these rules clearly before a small misunderstanding becomes a serious problem.

👀 We also provide free resources and blog articles to help foreigners, employers, and families better understand how to manage their immigration situation in Poland and stay informed about the latest legal changes, procedural updates, and practical requirements.

⚠️ One question we occasionally receive from foreign employees is:

"What happens if my employer refuses to provide Annex 1 for my residence permit application?"

In many cases, the refusal is not intentional. Sometimes the employer is unfamiliar with the immigration process. Sometimes the wrong person has been asked to sign the document. In larger organizations, the request may simply be delayed within internal approval procedures.

However, it is important to understand why Annex 1 matters.

For work-based residence permit applications, Annex 1 confirms key employment conditions to the immigration authorities, including information about the position, remuneration, and employment relationship. Without this information, the office may be unable to properly assess the application.

If your employer is reluctant to provide Annex 1, it may be worth taking a step back and asking a few practical questions:

• Has the reason for the refusal been clearly explained?
• Has the request been directed to the person authorized to represent the company?
• Do the employment conditions in practice match those stated in the employment contract?

Many situations can be resolved through communication and clarification. In some cases, additional guidance may be needed to help both the employee and employer understand their obligations and available options.

The key takeaway is simple: do not ignore the issue and do not attempt to complete or alter employer documents yourself.

✅ At BL Consultancy, we regularly assist both foreign nationals and employers in navigating residence permit requirements and employment compliance matters in Poland.

❓ Have you encountered challenges obtaining documents from an employer during your immigration process?

What was the biggest obstacle you faced?

𝗪𝗵𝗮𝘁 𝗵𝗮𝗽𝗽𝗲𝗻𝘀 𝘄𝗵𝗲𝗻 𝗮 𝗹𝗮𝘄 𝗱𝗼𝗲𝘀𝗻’𝘁 𝗰𝗵𝗮𝗻𝗴𝗲, 𝗯𝘂𝘁 𝘁𝗵𝗲 𝘄𝗮𝘆 𝗶𝘁 𝗶𝘀 𝗶𝗻𝘁𝗲𝗿𝗽𝗿𝗲𝘁𝗲𝗱 𝗱𝗼𝗲𝘀?Recently, I encountered a situation that perf...

𝗪𝗵𝗮𝘁 𝗵𝗮𝗽𝗽𝗲𝗻𝘀 𝘄𝗵𝗲𝗻 𝗮 𝗹𝗮𝘄 𝗱𝗼𝗲𝘀𝗻’𝘁 𝗰𝗵𝗮𝗻𝗴𝗲, 𝗯𝘂𝘁 𝘁𝗵𝗲 𝘄𝗮𝘆 𝗶𝘁 𝗶𝘀 𝗶𝗻𝘁𝗲𝗿𝗽𝗿𝗲𝘁𝗲𝗱 𝗱𝗼𝗲𝘀?

Recently, I encountered a situation that perfectly illustrates one of the biggest challenges in immigration law.

For nearly two years, a particular procedure for managing residence permit applications in Warsaw had been accepted without issue. Then, without any public announcement, the interpretation of a legal provision changed.

The result?

A process that had previously protected clients could suddenly create significant legal risk.

I only discovered the change while carefully reviewing the justification of a positive decision issued to one of my clients.

That discovery prompted an immediate review of all active cases.

Two clients were potentially affected.

One chose not to continue.

The other placed their trust in my assessment and remained patient while we developed an alternative strategy.

Months later, that client received a positive decision and a 3-year residence permit.

This experience reinforced something I often tell clients:
Immigration success is not only about knowing the law. It is about understanding how authorities apply it in practice and recognizing when those practices change.

It is also why transparency matters.

Every client should have access to information about their case whenever legally possible. They should know their case number, understand the status of their application, and receive honest communication about potential risks.
As immigration professionals, we cannot control every legal interpretation or procedural change.

What we can do is remain vigilant, communicate openly, and act quickly when circumstances change.

To everyone who has trusted BL Consultancy with their immigration matters, thank you.

And to anyone currently navigating Poland's immigration system: stay informed, stay involved in your case, and work with someone who values transparency as much as results.

If you need support with residence permits, work permits, EU Long-Term Residence, EU Blue Cards, citizenship applications, or immigration compliance in Poland, we would be happy to help.

Regards,
Beata.

ALL DECISIONS ARE WORTH WAITING FOR. SOME BRING EXTRAORDINARY JOY.

Her journey began in childhood, with the stories she heard from her mother and grandmother about Poland and their Polish ancestors. The next step was moving to Poland to study here. After graduating, she tried living in her home country again, but she missed Poland too much. She returned, and that's when we met.

First came the Pole's Card, then permanent residence, the Polish language exam, and now the culmination of her life's journey – Polish citizenship!

The job I do can sometimes be very frustrating, and occasionally I dream of doing something else, something less stressful. But then a document like this arrives, and it reminds me why I do what I do.

Decisions like this don't come every day, which is why I thought it would be nice to share this one with you :)
