Death-bed acknowledgement of debt: an acknowledgment of a debt ay be made as well during death-illness as "in health"

When the only proof of a debt is an acknowledgment made during marz-ul-maut or death-illness, the debt must not be paid until after payment of debts acknowledged by the deceased while he was in health and of debts proved by other evidence. an acknowledgment of a deb made during death-illness in favour of an heir is no proof at all of the debt, and no effect can be given to it.

Gift made during marz-ul-Maut:
A gift made by a Muslim during marz-ul-Maut or death-illness cannot take effect beyond a third of his estate after payment of funeral expenses and debts, unless t the heirs give their consent, after the death of the donor, to the excess taking effect; nor can such a gift take effect if made in favour of an their unless the other heirs consent hereto after donor's death.(a)

DIVISION OF HEIRS:
The SHIAS divide heirs into two groups, namely, (1) heirs by consanguinity, that is, blood relations,km and (2) heirs by marriage, that i, husband and wife.

Heirs by consanguinity are divided into three classes and each class is sub-divided into to two sections. of three classes of heirs, first excludes second from inheritance and second excludes third. Daughter's sons being heirs of first class exclude nephews of the deceased who are the heirs of second class. (b)

درست نکاح کے ثبوت کے دو گواہوں کی موجودگی لازمی ہے۔ جہاں مرد اور عورتیں دونوں نکاح کے حقیقت کو تسلیم کرتے ہیں اور ایک دوسرے کے ساتھ سنجیدہ شادی کرتے ہیں ، پھر گواہی پیش کرنے کا تقاضا لازمی نہیں ہے کہ نکاح کو منسلک کیا جائے ، جو دونوں میاں بیوی کے ذریعہ علم میں سے ہو۔
