We strongly condemn the false and fabricated implication of a former judicial officer through a mala fide FIR, which appears to have been lodged with ulterior motives and constitutes a clear abuse of the process of law. It is highly concerning that the said judicial officer was previously dismissed from service solely on the basis of a complaint made by a serving Senior Superintendent of Police, which, in itself, raises serious doubts regarding fairness and impartiality.
The entire sequence of events clearly indicates a pattern of victimization aimed at damaging the reputation and integrity of the former judicial officer through engineered and baseless allegations.
In these circumstances, it is imperative that a fair, transparent, and impartial inquiry be conducted by an independent and competent authority in order to ascertain the true facts and bring justice to light.

Scope and application of Sec. 302(a), 302(b) 302(c) PPC. and Sec.34, 149 PPC

For what has been discussed above, we are inclined to issue following guidelines to the courts below to follow in future:

i) that the Trial Court seized with the criminal trial is squarely required to adhere to the provision of Sections 265-C, 265-D Cr.P.C for the purpose of initiation of trial, before framing of charge as ordained to meet the spirit of the law of the land;

ii) That the Trial Court is under obligation to fulfill the requirement as stated above, thereafter to frame charge, while minutely looking into the contents of the crime report, statement of the prosecution witnesses under Section 161 Cr.P.C, report under Section 173 Cr.P.C and all other documents appended with the challan with an intent to evaluate whether the criminal act as disclosed has been committed in furtherance of joining hands, which attracts the ingredients of common intention (Section 34 PPC) or common object (Section 148/149 PPC read with the substantive offence), if so, the charge would be framed accordingly;

iii) That the Trial Court after recording of evidence, statement of the accused under Section 342 Cr.P.C would provide an opportunity to the accused to lead defence, if any, and further to appear under Section 340(2) Cr.P.C (if he intends to appear) & defence evidence, if any, thereafter, it is obligatory for the courts to give judgment with definite finding qua the element of common intention or common object with reference to the substantive offence;

iv) That the Court proceeding with the matter, if reaches to the conclusion that the offence committed is an individual liability then the provision of Section 302(c) PPC would be squarely applicable and each accused would be dealt with according to the gravity of allegation, if any?

Note: The Trial Court while rendering such finding has to disclose judicial reasoning.

​عدالتی فیصلے کا خلاصہ

----Ss. 3 & 4---Illegal Dispossession Act, 2005, applicability of---Petitioner was aggrieved of Trial Court's order whereby his complaint filed under S.3 of Illegal Dispossession Act, 2005, was dismissed---Held: Petitioner contended that he filed complaint under S.3 of Illegal Dispossession Act, 2005, which was withdrawn on 6.12.2022---There was no embargo to file a subsequent complaint as neither charge was framed nor evidence was recorded and early complaint was withdrawn bonafidely in view of the negotiations with the respondents, who was the brother of the appellant---On the other hand, respondents claimed that the property belonged to their father since 1974 but the appellant had managed to procure the leasehold rights of the property behind the back of the respondent who was the real brother of appellant---Contention raised by respondent was that the Act was enacted in 2005 and dispute pertained to property obtained in 1974---Complaint could only be decided by the Trial Court once complaint had been fixed for hearing before the Trial Court, which could determine as to whether averments and material would attract the statute which had been enacted in 2005---This related to the merits of the case and could not be adjudicated or discharged by this (High) Court---No observation could be given that might affect the merits of the case before the Trial Court as Trial Court would have to consider the essential ingredients which included the commission of offence and culpability within ambit of S.3 of the Act ibid---Thus, impugned judgment was set aside while allowing the criminal revision with direction to the Trial Court to register the complaint and firstly decide the essential question of applicability of said Act, 2005, as urged by respondents that property in question was their ancestral property since 1974 and fell outside the scope of said Act and only. thereafter the Trial Court might decide the complaint in accordance with law---Revision petition was disposed of. The Illegal Dispossession Act, 2005 was enacted to protect lawful owners and occupiers of immovable property from illegal occupants or land-grabbers who unlawfully or forcibly deprive them of possession. Since the IDA, 2005 is a special law and applies to specific circumstances, its provisions must be interpreted strictly, keeping in view its scope and applicability.
The Act identifies the persons who may approach the Court under Section 3, namely an “owner” or an “occupier.” According to Section 2(c), an “occupier” means a person in lawful possession of the property, while under Section 2(d), an “owner” means a person who was in fact the owner of the property at the time of dispossession, provided that he or she was dispossessed without due process of law.
Therefore, any person who is a lawful owner or lawful occupier and has been illegally dispossessed may file a complaint under the IDA, 2005. It is now a well-settled principle of law that, for establishing a case under Sections 3 and 4, the complainant must prima facie prove the following elements before the Court:
i) That he or she was the lawful owner or lawful occupier of the property in question;
ii) That the accused entered the property on a specific date, time, and in a specific manner without lawful authority;
iii) That the intention of the accused was to dispossess, occupy, control, or take over the property.
In the present case, the petitioner merely asserted that she had inherited a share in the property after the death of her husband. However, none of the above elements were established to the extent necessary to constitute a prima facie case of illegal dispossession against the accused.
In light of the facts and legal position, it can be concluded that the property in question was jointly owned by the respondents, their four sisters, and the petitioner’s deceased husband, Tahir Hussain Abbasi. Since the husband has passed away, the petitioner, as his widow, is entitled to her share in inheritance unless proved otherwise. However, she failed to establish that the respondents forcibly and illegally dispossessed her. The respondents themselves are co-owners claiming possession of the property, a material fact that the petitioner concealed in her complaint.
Furthermore, the contents of the complaint do not demonstrate that the petitioner was forcibly dispossessed. Accordingly, the learned Trial Court, after conducting inquiry and hearing arguments, rightly dismissed the complaint. The Peshawar High Court also upheld this order through its impugned judgment, which is fully consistent with the facts and the law.

موجودہ مقدمہ میں درخواست گزار نے صرف یہ دعویٰ کیا کہ اسے اپنے مرحوم شوہر کی وفات کے بعد وراثت کے ذریعے جائیداد میں حصہ حاصل ہوا، مگر مذکورہ بالا عناصر میں سے کوئی بھی اس حد تک ثابت نہیں ہو سکا کہ ملزمان کے خلاف غیر قانونی بے دخلی کا ابتدائی مقدمہ قائم ہو سکے۔
حقائق اور قانونی پوزیشن کو مدنظر رکھتے ہوئے یہ نتیجہ اخذ ہوتا ہے کہ متعلقہ جائیداد مدعا علیہان، ان کی چار بہنوں اور درخواست گزار کے مرحوم شوہر طاہر حسین عباسی کی مشترکہ ملکیت تھی۔ چونکہ شوہر وفات پا چکے ہیں، لہٰذا درخواست گزار بطور بیوہ اپنے وراثتی حصے کی حقدار ہے جب تک اس کے برعکس ثابت نہ ہو۔ تاہم وہ یہ ثابت کرنے میں ناکام رہی کہ مدعا علیہان نے اسے زبردستی اور غیر قانونی طور پر بے دخل کیا۔ مدعا علیہان خود بھی مشترکہ مالکان ہیں اور جائیداد پر قبضے کا دعویٰ رکھتے ہیں، جس اہم حقیقت کو درخواست گزار نے اپنی شکایت میں چھپایا۔
مزید برآں، شکایت کے مندرجات سے یہ ثابت نہیں ہوتا کہ درخواست گزار کو زبردستی بے دخل کیا گیا۔ لہٰذا معزز ٹرائل کورٹ نے تحقیق اور دلائل سننے کے بعد شکایت کو درست طور پر مسترد کیا، اور پشاور ہائی کورٹ نے بھی اپنے متنازعہ فیصلے کے ذریعے اس حکم کی توثیق کی، جو حقائق اور قانون کے عین مطابق ہے۔
