Present Legal Status of Deceased Son Quota in Pakistan — Supreme Court Judgment & Your Legal Rights Explained ⚖️

The “Deceased Quota” (also known as Son Quota / hereditary appointment quota) for government jobs in Pakistan was declared unconstitutional and discriminatory by the Supreme Court of Pakistan in its landmark judgment (PLD 2024 SC 1276, Civil Petition No. 3390 of 2021, dated 18 October 2024). Family members — widow, widower, spouse, or child of a deceased or medically retired civil servant — can no longer be appointed to government posts without open advertisement, competition, and merit.

However, a crucial clarification followed: this judgment does NOT apply retrospectively. It does not affect appointments already made, and it does not take away accrued rights or set aside past and closed transactions. This means that if your father or husband passed away or retired on medical grounds BEFORE the September/October 2024 Supreme Court judgment, your right to be appointed under the Deceased Quota may still be legally protected and enforceable.

Many families are unaware that their case may still qualify, or are being wrongly told by departments that the quota is “closed for everyone.” Understanding the exact cut-off, the correct legal procedure, and how to enforce your accrued right is critical — and time-sensitive.

KP Service Tribunal Sets Aside Subedar Major Promotion, Orders Consideration of Saif ur Rehman for Appointment

PESHAWAR: The Khyber Pakhtunkhwa Service Tribunal has set aside the promotion of a Subedar to the post of Subedar Major in the Malakand Levies Force and directed the competent authorities to reconsider the cases of all eligible candidates in accordance with the applicable service rules.

Nouman Muhib Kakakhel, Advocate, represented Subedar Saif ur Rehman before the Tribunal.

During the proceedings, counsel argued that Subedar Saif ur Rehman was the only Subedar among the candidates who possessed a graduate degree, yet a comparatively less-qualified candidate was promoted to the post of Subedar Major.

Counsel further contended that the educational qualification prescribed under the applicable promotion rules had been ignored and that the impugned promotion was therefore contrary to the governing service rules.

After hearing the arguments, the Tribunal set aside the notification promoting the Subedar to the post of Subedar Major, holding that the matter required fresh consideration in accordance with law.

The Tribunal directed the competent authority to place the cases of Subedar Saif ur Rehman, the previously promoted official and other eligible candidates before the Departmental Promotion Committee for fresh consideration strictly in accordance with the applicable rules.

The Tribunal further directed that the exercise be completed within the prescribed period. Subedar Saif ur Rehman has consequently been recommended for appointment against the post of Subedar Major, subject to the outcome of the fresh consideration in accordance with law.

Nouman Muhib Kakakhel, Advocate, appeared on behalf of Subedar Saif ur Rehman before the Khyber Pakhtunkhwa Service Tribunal.

Rs7 Crore Cheque Dishonour Case: Peshawar Court Grants Bail to Accused

PESHAWAR | JURISTS NEWS: An Additional Sessions Judge, Peshawar, on Monday granted bail to Sohail Arshad, who is accused of issuing a cheque worth Rs70 million (Rs7 crore) to Ajmal Khan which was allegedly dishonoured upon presentation.

The accused was represented by Nouman Muhib Kakakhel, Advocate, before the court.

During the hearing, the defence counsel argued that the complainant had no substantive evidence to establish the alleged transaction apart from the cheque itself. The counsel contended that the complainant had also failed to establish the source of the alleged Rs70 million, the mode through which the amount was transferred, and whether the requisite taxes had been paid.

The defence further argued that the essential ingredients of Section 489-F of the Pakistan Penal Code were not satisfied and that the prosecution had failed to establish a prima facie case against the accused.

According to the defence, the dispute arose from an earlier financial and property-related transaction. The counsel submitted that the complainant had acted as a Jirga mashar in an attempt to resolve a dispute involving approximately Rs20 million allegedly owed to the accused.

The defence case was that, during the settlement process, a property was offered to the accused in lieu of the amount allegedly recoverable by him. The accused was subsequently asked to pay an additional Rs15 million to another disputing party on the premise that the property was valued at Rs35 million.

The counsel alleged that the property ultimately turned out to be non-existent or incapable of being validly transferred to the accused and that the accused had himself been subjected to a financial loss in the transaction.

The defence maintained that the matter essentially involved a civil dispute requiring determination by a competent court and argued that the case did not fall within the prohibitory clause applicable to bail.

After hearing the arguments, the court allowed the bail petition and directed the accused to furnish two sureties of Rs1 million each.

The allegations against the accused have not been finally adjudicated and remain subject to determination by the competent court.

MTI Amendment Act 2026 — Important Change for MTI Employees ⚖️

Are you an MTI employee facing an employment issue, service matter, disciplinary action, or workplace grievance?

The MTI Amendment Act 2026 has introduced an important change in the grievance redressal procedure for MTI employees. Under the amended law, an employee is required to approach the Grievance Redressal Committee first regarding their employment-related grievance. This means that understanding the MTI employee grievance procedure, MTI Tribunal jurisdiction, and the role of the Grievance Redressal Committee is now particularly important before pursuing a service or employment dispute.

If you are an MTI employee in Pakistan and have a grievance relating to your employment, service, disciplinary proceedings, or other employment matters, knowing the correct legal forum and procedure can make a significant difference.
