Important Tax Update

ATIR Lahore has held that Super Tax may be adjustable against available refunds.

As reported by Business Recorder on 11 July 2026, the Appellate Tribunal Inland Revenue, Lahore observed that although Super Tax under section 4C is an independent charge, it still qualifies as “tax due under the Income Tax Ordinance, 2001.”

Accordingly, where a verified refund or excess tax is available, the Commissioner should first examine and adjust the same before initiating coercive recovery proceedings.

Key takeaway:
Refund adjustment and tax credit adjustment are not the same. Available refunds cannot be ignored merely because Super Tax is a separate charge.
