⚖️ A Significant Tax Litigation Success

Aziz Law Company successfully represented M/s S.A. Construction Company before the Appellate Tribunal Inland Revenue, Lahore.

The appeal was allowed, setting aside a Rs. 347,998/- default surcharge demand. The Tribunal held that consequential surcharge could not independently survive where the underlying principal tax liability had already been set aside.

Relief secured for M/s S.A. Construction Company, Faisalabad — the Tribunal has set aside a default surcharge demand of Rs. 347,998/- levied under Sections 205/137 of the Income Tax Ordinance, 2001.

The Tribunal held that a consequential liability cannot survive once its principal demand has been vacated. Since the underlying super tax demand under Section 4C had already been set aside in an earlier order (ITA No. 1236/LB/2026) pending fresh adjudication after the outcome of the appeal against the amended assessment under Section 122(5A), the default surcharge — being purely consequential — could not be sustained independently.

The Hon’ble Appellate Tribunal Inland Revenue (ATIR) has decided the matter in favour of the taxpayer and allowed tax credit under section 65B and 65D of the income tax ordinance, 2001 and allow the appeal filed by tax payer, thereby setting aside the adverse order passed by the tax authorities. The Tribunal, after examining the facts, relevant provisions of law, and contentions of the taxpayer, granted relief to the taxpayer.
