عدالتوں پر اعتماد دراصل معاشرے پر اعتماد ہے
اکثر یہ کہا جاتا ہے کہ لوگوں کا عدالتوں پر اعتماد کم ہو چکا ہے، مگر زمینی حقائق اس کے بالکل برعکس ہیں۔ آج بھی لاکھوں لوگ اپنے حقوق، جائیدادوں، کاروباری تنازعات اور آئینی تحفظ کے لیے پوری سنجیدگی اور اعتماد کے ساتھ عدالتوں سے رجوع کرتے ہیں اور قانون کے طے کردہ ہر مرحلے سے گزرتے ہیں۔ حقیقت یہ ہے کہ عدالتوں پر عدم اعتماد کی عمومی فضا پیدا کرنا صرف ایک ادارے پر تنقید نہیں بلکہ پورے قانونی اور سماجی ڈھانچے پر سوال اٹھانے کے مترادف ہے۔
جن افراد کو اپنی رکی ہوئی رقوم واپس ملتی ہیں، جن کے املاک کے حقوق بحال ہوتے ہیں، جنہیں سرکاری اداروں کے خلاف ریلیف حاصل ہوتا ہے اور جن کے بنیادی حقوق کا تحفظ ممکن بنتا ہے، ان تمام کامیابیوں کے پیچھے عدالتی نظام کا بنیادی کردار ہوتا ہے۔ قانون کی حکمرانی صرف کتابوں میں لکھی ہوئی ایک اصطلاح نہیں بلکہ روزانہ عدالتوں میں ہونے والی کارروائیوں کے ذریعے ایک زندہ حقیقت کی صورت اختیار کرتی ہے۔
بطور وکلاء، ہمیں متعدد آئینی مقدمات اور رِٹ پٹیشنز میں عدالتوں سے رجوع کرنے اور مؤثر ریلیف حاصل کرنے کا موقع ملا ہے۔ ان میں بعض معاملات صرف انفرادی نوعیت کے نہیں تھے بلکہ ان کے اثرات قومی سطح تک محسوس کیے گئے۔ مثال کے طور پر، فروری 2025 کے انتخابات کے حوالے سے دائر کی گئی ہماری آئینی درخواست کے نتیجے میں، متعلقہ اتھارٹی نے عدالت میں اپنا جواب جمع کرواتے ہوئے انتخابی شیڈول اور تاریخ سے متعلق مؤقف پیش کیا۔ یہ ایک ایسا موقع تھا جس نے ایک بار پھر یہ ثابت کیا کہ جب آئینی سوالات عدالتوں کے سامنے رکھے جاتے ہیں تو ان کے اثرات محض فریقین تک محدود نہیں رہتے بلکہ پورے معاشرے پر مرتب ہوتے ہیں۔ ان معاملات کی تفصیلات پر ہم کسی اور موقع پر تفصیل سے گفتگو کریں گے۔
اسی طرح حالیہ دنوں میں ستائیسویں آئینی ترمیم کو چیلنج کرنے والے مقدمات اور ان پر فل بینچز کی تشکیل بھی اس حقیقت کی عکاس ہے کہ عدالتیں آج بھی اہم آئینی سوالات سننے اور ان پر فیصلہ کرنے کا کردار ادا کر رہی ہیں۔ ہماری پیشہ ورانہ زندگی میں بھی ایسے متعدد مواقع آئے ہیں جہاں قومی اہمیت کے معاملات میں عدالتوں نے ہماری آئینی درخواستوں کو نہ صرف سماعت کے لیے منظور کیا بلکہ قانون کے مطابق مؤثر ریلیف بھی فراہم کیا۔
یہ تمام مثالیں اس بات کا ثبوت ہیں کہ عدالتیں صرف کمزور یا طاقتور فریق کے درمیان توازن قائم نہیں کرتیں بلکہ قانون کی بالادستی کو یقینی بناتی ہیں۔ ایک مضبوط قانونی مؤقف، آئین کی گہری سمجھ اور پیشہ ورانہ تیاری ہی وہ عناصر ہیں جو عدالتوں میں کامیابی کی بنیاد بنتے ہیں۔
ہم سمجھتے ہیں کہ آئینی مقدمات محض قانونی چارہ جوئی نہیں ہوتے بلکہ وہ شہری آزادیوں، بنیادی حقوق اور ریاستی اداروں کے آئینی حدود کے تعین کا ذریعہ بھی ہوتے ہیں۔ یہی وجہ ہے کہ ایک ذمہ دار وکیل کے لیے عدالت صرف ایک فورم نہیں بلکہ انصاف، آئین اور قانون کی حکمرانی کی علامت ہے۔
قانون پر یقین رکھیے، عدالتوں پر اعتماد قائم رکھیے، کیونکہ ایک مہذب معاشرہ ہمیشہ اپنے اداروں اور اپنے آئین کے ذریعے ہی مضبوط ہوتا ہے۔

اگر آپ اسے مزید طاقتور بنانا چاہتے ہیں تو آخر میں “ہم صرف مقدمات نہیں لڑتے، بلکہ آئینی اصولوں اور شہری حقوق کے تحفظ کے لیے کھڑے ہوتے ہیں” جیسا ایک اختتامی جملہ بھی شامل کیا جا سکتا ہے۔
Confidence in the Courts is, in Reality, Confidence in Society Itself
It is often claimed that people have lost faith in the courts, yet the facts on the ground tell a very different story. Even today, countless individuals continue to approach the courts for the protection of their rights, properties, businesses, and constitutional freedoms. They appear before the courts with discipline and conviction, because they still believe that the rule of law remains the strongest guarantee of justice. To create a narrative that people no longer trust the courts is, in many ways, to undermine the very legal and social fabric that binds our society together.
Every recovery of lawful dues, every restoration of property rights, and every protection of fundamental liberties ultimately finds its foundation in the judicial process. The rule of law is not merely an abstract principle; it is a living reality that manifests itself in courtrooms every single day.
As legal practitioners, we have had the privilege of appearing in numerous constitutional and writ matters, securing meaningful relief in cases that have often extended beyond individual interests and carried implications of national importance. One such example relates to the elections of February 2025, where, pursuant to our constitutional petition, the relevant authority appeared before the court and announced its position regarding the election schedule and dates. It was a significant moment that demonstrated how constitutional litigation can influence matters affecting society at large. We hope to discuss the details of that case on another occasion.
Similarly, the recent constitutional challenge concerning the Twenty-Seventh Amendment, and the constitution of a full bench to hear the matter, further illustrates that the courts continue to serve as the ultimate forum for the adjudication of questions of national and constitutional significance. Our professional experience includes several such matters in which constitutional petitions were not only entertained by the courts but also resulted in substantial and effective relief.
These examples reaffirm an important truth: courts do not merely protect the weak against the powerful; they ensure that every individual and institution remains subject to the supremacy of law. Strong legal preparation, constitutional understanding, and professional competence are the foundations upon which justice is pursued and achieved.
Constitutional litigation is not simply about legal procedure—it is about safeguarding fundamental rights, preserving democratic values, and defining the constitutional limits of public authority. For every responsible lawyer, the courtroom represents far more than a place of advocacy; it embodies the enduring principles of justice, constitutionalism, and the rule of law.
Let us continue to place our faith in the law and in the institutions entrusted with its protection, for a strong society is built not on cynicism, but on its commitment to justice and constitutional order.
