سپریم کورٹ آف پاکستان نے اس اہم کیس (شاہباز مسیح کیس) میں بچوں کی شادیوں کی ممانعت سے متعلق قانون (Child Marriage Restraint Act, 1929) کی تشریح اور عدالتی نظائر (Binding Precedents) کے اختیار کے حوالے سے بنیادی اصول وضع کیے ہیں۔
عدالت نے قرار دیا کہ مذکورہ قانون محض کم عمری میں شادی کے انعقاد کو قابلِ سزا جرم قرار دیتا ہے۔ قانون ایسی شادی کو صراحتاً نہ تو باطل (Void) قرار دیتا ہے اور نہ ہی قابلِ تنسیخ (Voidable) ٹھہراتا ہے۔ اس کا مطلب ہے کہ قانون کے تحت ایسی شادی جرم تو ہے، مگر قانونی طور پر خود بخود کالعدم نہیں ہوتی۔
عدالتی نظائر کی پابندی کے حوالے سے، عدالت نے واضح کیا کہ اس کی بنیاد آئینی درجہ بندی (Constitutional Hierarchy) پر ہوتی ہے، نہ کہ کسی ادارہ جاتی برتری پر۔ چونکہ آئینی تعبیر و تشریح کا حتمی اختیار سپریم کورٹ آف پاکستان میں مرتکز ہے، اس لیے تمام عدالتیں، بشمول سپریم کورٹ آف پاکستان (اصولی طور پر)، اس کے فیصلوں کی پابند ہیں۔
تاہم، عدالت نے ایک اہم اصول وضع کیا: بطور اصول، عدالت سپریم کورٹ آف پاکستان کی سابقہ آئینی نظیر (Constitutional Jurisprudence) کا احترام کرے گی اور اس کی پیروی کرے گی۔ لیکن، اگر یہ ثابت ہو جائے کہ مذکورہ نظیر صریحاً غلط ہے، آئین کے متن یا ڈھانچے سے متصادم ہے، یا بنیادی حقوق اور عصری آئینی اقدار سے غیر مطابقت رکھتی ہے، تو ایسی نظیر کی پیروی نہیں کی جائے گی اور اسے تبدیل کیا جا سکتا ہے۔

Case Details:
The Supreme Court of Pakistan, in this landmark Shahbaz Masih case, established foundational principles regarding the interpretation of the Child Marriage Restraint Act, 1929, and the authority of binding judicial precedents. The Court held that the said Act only penalizes the solemnization of child marriage as a punishable offense. It does not explicitly declare such a marriage void or voidable. Therefore, under this Act, minor marriage is a criminal offense but not automatically legally invalid.
Regarding the binding nature of judicial precedents, the Court clarified that it rests on constitutional hierarchy, not institutional superiority. As the final authority on constitutional interpretation is centralized in the Supreme Court of Pakistan, all courts, including the Supreme Court itself (in principle), are bound by its decisions.
However, the Court established a critical principle: as a general rule, the Court will respect and follow previous constitutional jurisprudence of the Supreme Court of Pakistan. Nevertheless, a precedent will be departed from if it is proven to be explicitly wrong, conflicts with the text or structure of the Constitution, or is incompatible with fundamental rights and contemporary constitutional values. Previous decisions can be overruled under these conditions.
