⚖️ CASE UPDATE | HIGH COURT ALLOWS CONSTITUTIONAL PETITION; ORDERS FORENSIC EXAMINATION OF DISPUTED SIGNATURES & THUMB IMPRESSIONS

We are pleased to share another success from our constitutional litigation practice before the Hon’ble High Court of Sindh Bench at Sukkur.

The matter was argued by our Founding and Managing Partner, Mr. Farooq Goraho (Farooq Iftikhar Goraho), Advocate, on behalf of the Petitioner in a dispute involving an allegedly forged sale agreement and disputed cheques.

The Petitioner consistently maintained that the signatures and thumb impressions appearing on the impugned documents were forged and sought forensic examination through a handwriting and fingerprint expert. The application was dismissed by both the Trial Court and the Revisional Court.

The Hon’ble High Court was pleased to allow the Constitutional Petition, set aside the concurrent orders of the Trial and Revisional Courts, and direct forensic examination of the disputed signatures and thumb impressions through a handwriting and fingerprint expert.

We are pleased to share another significant success from our civil litigation practice before the Court of the Senior Civil Judge/Rent Controller-III, Karachi East.

The matter was argued on behalf of the Plaintiffs by our Founding and Managing Partner, Mr. Rafeo Junejo (Rafeo Fazal Juenjo), Advocate, in a dispute concerning multiple properties and a petrol pump business established and operated by the Plaintiffs.

After hearing the parties, the Hon’ble Court was pleased to allow all three applications filed by the Plaintiffs and granted the following reliefs:

• Appointment of the Nazir as Receiver to take over the accounts, income, and profits of the petrol pump business pending adjudication.

• Grant of status quo in respect of all suit properties.

• Allowance of the application for inspection of the suit properties.

⚖️ CASE UPDATE | HIGH COURT SUSPENDS SEALING NOTICE
We are pleased to share another significant success from our constitutional litigation practice before the Hon’ble High Court of Sindh at Karachi.
The matter was argued by our Founding and Managing Partner, Mr. Farooq Goraho (Farooq Iftikhar Goraho), Advocate, on behalf of the Petitioner, who challenged a notice dated 22.12.2025 whereby only 24 hours were granted to respond, coupled with threats of sealing the Petitioner’s residential premises.
It was contended that the property was being used solely for residential purposes and that the proceedings referred to in the impugned notice had no nexus with the Petitioner.
After hearing the matter, the Hon’ble Court found that the point raised required consideration, issued notices to the Respondents and the Advocate General, Sindh, and was pleased to suspend the operation of the impugned notice dated 22.12.2025 pending further proceedings.
This order reinforces the fundamental principle that administrative actions carrying serious civil consequences must be undertaken fairly and in accordance with the principles of due process and natural justice.

⚖️ CASE UPDATE | JUSTICE OF PEACE DIRECTS REGISTRATION OF F.I.R.
We are pleased to share a recent success from our practice before the Court of Sessions Judge / Ex-Officio Justice of Peace, Badin.
The matter in Cr.M.A. No. 913 of 2026 was argued by our Founding and Managing Partner, Farooq Goraho (Farooq Iftikhar Goraho), Advocate, on behalf of the Applicant in a dispute involving serious allegations of criminal trespass, intimidation, and alleged unlawful interference over agricultural land.
Despite repeated attempts, the Applicant’s complaint was not entertained by the concerned police station, prompting proceedings before this Court.
After hearing arguments, the Hon’ble Court observed that the allegations, on their face, disclose cognizable offences requiring investigation, and that civil proceedings do not bar registration of criminal cases where separate criminal conduct is alleged.
Accordingly, the Hon’ble Court allowed the application and directed:
• Recording of the Applicant’s statement under Section 154 Cr.P.C.
• Registration of F.I.R., if cognizable offences are made out
• Fair, impartial, and transparent investigation by police authorities
This order reinforces the settled principle that where cognizable offences are disclosed, police authorities are legally bound to act under Section 154 Cr.P.C.
Matter was effectively argued, securing relief for the Applicant.

Throwback to another significant development from our litigation practice before the Hon’ble High Court of Sindh Bench at Sukkur.
A false F.I.R. and multiple Summary Suits were instituted against our client on the basis of an allegedly forged sale agreement, wherein stolen cheques belonging to our client were allegedly misused in connection with the said transaction. Our client’s cheque book had reportedly been stolen prior to the initiation of the proceedings.
The matter, arising out of a Constitutional Petition challenging an order passed in Civil Revision proceedings, was argued by our Founding and Managing Partner, Mr. Farooq Goraho (Farooq Iftikhar Goraho), Advocate, on behalf of the Petitioner.
Upon hearing the matter, the Hon’ble Court was pleased to direct that the trial Court shall not proceed with:
• F.C. Suit No.66 of 2021
• Summary Suit No.23 of 2021
• Summary Suit No.24 of 2021
• Criminal Case No.26 of 2021, arising out of F.I.R. No.13 of 2021
The Hon’ble Court not only suspended proceedings in the connected civil matters, but also stayed the connected criminal proceedings, despite the Constitutional Petition having arisen from a civil revision order passed in a civil suit.
Securing suspension of multiple connected proceedings arising out of the same controversy required careful legal strategy, detailed preparation, and effective advocacy before the Hon’ble Court.
We are further pleased to share that the said Constitutional Petition has now been allowed in favour of our client by the Hon’ble High Court. The detailed judgment/order shall be shared soon.

We are pleased to share a significant development from one of our recent litigations before the Special Court for Cooperative Societies, Karachi Division.
The matter in Society Suit No. 748 of 2026 was argued by our Founding and Managing Partner, Mr. Farooq Goraho (Farooq Iftikhar Goraho), Advocate, assisted by Mr. Sajjad Nawaz Sabir, on behalf of M/s Mercantile Co-Operative Credit Society Limited, in proceedings concerning unlawful interference and forcible dispossession of the Society’s premises, despite an earlier order dated 07.03.2026 through which possession had already been lawfully restored via the Nazir with police assistance.
The Hon’ble Court, after hearing detailed arguments and examining the record, including the Nazir’s report, observed that the earlier judicial order had attained finality and remained unchallenged, and that any subsequent interference with possession was patently without lawful authority and in clear defiance of the Court’s directions.
Accordingly, the Hon’ble Court was pleased to pass the following directions:
• Immediate restoration of possession of the Society’s office/premises through the Nazir
• Full assistance by the Senior Superintendent of Police (South) and the concerned SHO for ex*****on of the order
• Registration of an F.I.R. against the individuals involved in unlawful dispossession and allied offences
• Submission of compliance reports before the next date of hearing
This order was secured through effective representation by Mr. Farooq Iftikhar Goraho, Advocate, who successfully advanced the matter before the Hon’ble Court.
This order reinforces a fundamental principle of law: no party can circumvent or defeat a subsisting judicial order through force, coercion, or unlawful occupation, and courts will ensure strict enforcement of their directions in accordance with law.
