๐Ÿ‡ต๐Ÿ‡ฐโš–๏ธ๐Ÿ‡ฎ๐Ÿ‡ณ PAKISTAN vs INDIA: THE BATTLE FOR BASMATI RICE IN AUSTRALIA ๐ŸŒพ

A significant Intellectual Property battle has emerged over one of South Asia's most famous agricultural products โ€” Basmati Rice.

๐Ÿ‡ฎ๐Ÿ‡ณ India sought exclusive certification trade mark protection for โ€œBasmatiโ€ in Australia.

๐Ÿ‡ต๐Ÿ‡ฐ Pakistan opposed the claim, arguing that Basmati is not exclusively Indian and has a long-established historical and geographical connection with regions in both Pakistan and India.

โš–๏ธ The Australian legal proceedings resulted in a major outcome protecting the ability of Pakistani producers and exporters to continue using the name โ€œBasmatiโ€ for genuine Pakistani Basmati rice.

Why does this matter? ๐Ÿค”

๐ŸŒพ Protects Pakistan's Basmati exports
โš–๏ธ Prevents exclusive monopoly over a historically shared product name
๐ŸŒ Highlights the importance of Geographical Indications and certification marks
๐Ÿ“œ Demonstrates how Intellectual Property rights can directly impact international trade

The battle over Basmati is more than just about rice โ€” it is about heritage, geography, international trade and Intellectual Property rights.

๐Ÿ‡ต๐Ÿ‡ฐ๐ŸŒพ Pakistan's Basmati identity remains protected in the Australian market.

When a Copycat Registers your trademark.

The Luckin Coffee trademark dispute in Thailand is a particularly useful case for understanding trademark squatting, bad-faith and infringement.

โ˜• Luckin Coffee v. Royal 50R Group โ€” Thailand

Luckin Coffee is a major Chinese coffee chain whose branding includes the distinctive deer-head logo.

A Thai company, Royal 50R Group, registered trademarks in Thailand resembling Luckin's branding and subsequently operated coffee shops using the Luckin Coffee name, similar logo, store design and packaging.

The similarity was particularly striking: the deer in the Thai version was essentially the same concept but facing in the opposite direction.

2. The important problem: Thailand registration came first
Luckin discovered that the Thai registrations already existed when it sought to protect its brand in Thailand.

This created a classic territorial trademark problem:

A brand can be famous in its home country and internationally, but that does not automatically mean it owns the corresponding trademark registration in every foreign country.

3. Luckin initially lost
The dispute produced a surprising result in the earlier litigation.

In 2023, Thailand's Court of Appeal for Specialized Cases ruled against Luckin. The decision was associated with a procedural/ownership issue concerning whether the Luckin entity bringing the action had the requisite rights at the relevant time, rather than a definitive finding that the Thai copycat had legitimately created the brand.

This was an important lesson: even a strong substantive trademark case can fail if ownership, standing and chain-of-title issues aren't properly established.

4. Luckin changed its litigation strategy
Luckin brought a new proceeding before Thailand's Central Intellectual Property and International Trade Court (IP&IT Court).

On 6 February 2025, the court ruled in Luckin's favor and recognized Luckin's better/prior rights in the Luckin Coffee trademark and deer logo. The court ordered cancellation of the opposing Thai trademark registration and prohibited the defendants from using the Luckin Coffee name, Chinese name ็‘žๅนธๅ’–ๅ•ก,
