Justice Mansoor Ali Shah has, for the first time, recognized the doctrine of "Constructive Continuity" in service matters through a recently pronounced authoritative judgment.
The "Doctrine of Constructive Continuity," as articulated in this judgment, is a legal fiction that treats a civil servant’s period of unlawful removal or dismissal as if it never occurred. It reconstructs the continuity of service, entitling the employee to all benefits and entitlements they would have received had the unlawful order not been passed. Essentially, it restores the employee to their original position, ensuring that wrongful acts do not cause lasting disadvantage or loss of service benefits.
