SSR & Co., Advocates & Legal Consultants, successfully represented the National Highway Authority (NHA) in a civil dispute concerning the operation, management and collection of toll revenue under a public procurement contract.

Mr. Saad Javid Satti, Managing Partner of SSR & Co., argued the matter on behalf of NHA and successfully secured the vacation of the ad-interim injunction restraining NHA from encashing the financial guarantees and bid security submitted by the plaintiff.

The learned Court held that the plaintiff had failed to establish a prima facie case, that the balance of convenience did not lie in its favour, and that any alleged loss was ascertainable in monetary terms and therefore did not constitute irreparable loss. Consequently, the application for temporary injunction under Order ###IX Rules 1 and 2 of the Code of Civil Procedure, 1908, was dismissed.

As a result, NHA may now proceed with the encashment of the financial guarantees and take all consequential measures arising from the termination of the contract, in accordance with the applicable contractual and legal framework.

SSR & Co. is pleased to share a recent professional milestone achieved on behalf of our client, the National Highway Authority (NHA).

After detailed and extensive arguments by our Partner Muhammad Sannan Khan, before the learned Civil Court, three similar matters instituted under Section 20 of the Arbitration Act, 1940 were dismissed on the preliminary objection of limitation. The matters were successfully contested on the basis of Article 181 of the Limitation Act, 1908, which prescribes a three-year limitation period for applications where no specific period is provided.

The Court reaffirmed the settled principle that the right to seek reference to arbitration accrues when the dispute crystallizes, and that subsequent correspondence or representations do not extend or revive the period of limitation. Once a matter is found to be barred by time, the Court cannot proceed into the merits of the case

On behalf of the Murree Hotels & Restaurants Association and various affected shop owners on Mall Road, SSR & Co. has challenged the acquisition proceedings initiated by the Government of Punjab and Municipal Corporation Murree.

Appearing before the Lahore High Court, Rawalpindi Bench, our Managing Partner Mr. Saad Javid Satti argued that the entire acquisition process is vitiated for non-compliance with Rules 3, 4 & 5 of the Punjab Land Acquisition Rules, 1983 and for failure to submit an Environmental Impact Assesment under Section 12 of the Pakistan Environmental Protection Act, 1997. The Court has issued notices to all respondents, including the Environmental Protection Agency and the Walled City of Lahore Authority.

We remain committed to due process, environmental safeguards, and the rights of local businesses.

Appellate Tribunal rules that service of orders via IRIS portal alone does not constitute valid service under Section 218(1)(d) of the Income Tax Ordinance, 2001, and condones delay in filing appeal.

This landmark decision clarifies that merely uploading an order to the IRIS portal does not fulfill the legal requirement for service, which must be done through prescribed modes like email or registered post as per Rule 74. The ruling reinforces the importance of due process and protects taxpayers' right to appeal.
