⚖️ 2025 SCMR 527 | A Significant Principle of Constitutional Jurisdiction

The Hon’ble Supreme Court of Pakistan in 2025 SCMR 527 reaffirmed that where a statute provides a complete mechanism and a specific forum for deciding questions of law or fact through an appeal or revision, that statutory remedy must first be exhausted. A party cannot bypass the legal procedure and directly invoke the constitutional jurisdiction of the High Court.

The judgment further clarifies that constitutional amendments are not retrospective unless the Legislature expressly provides otherwise. Applying amendments retrospectively would unsettle concluded matters and open the floodgates for reopening countless decided cases.

Whether time is the essence of a contract depends on the wording of the agreement, the intention of the parties, and the facts of each case. This principle reflects one of the strongest foundations of law and justice. A person cannot be allowed to gain an advantage by committing an unlawful act or by taking benefit from their own misconduct. Courts consistently uphold this doctrine to ensure that justice prevails over unfairness and that the legal system does not reward wrongful conduct.
