⚖️ Discharge vs Acquittal: Know the Difference
Two terms, often confused, with very different legal consequences under the Criminal Procedure Code, 1898:
🔹 Discharge: The accused is released from the case, usually at an early stage, without a decision on the merits. Fresh proceedings may be possible (e.g., under Section 63 CrPC or Section 249-A/265-K).
🔹 Acquittal: The court declares the accused not guilty after trial, on the merits. Under Section 403 CrPC, the accused cannot be tried again for the same offence.
Understanding this distinction can shape your legal strategy and protect your rights.
