Message of Farrukh Tanoli Sahib

The SBP in their letters to the 4 privatized banks has relied upon instructions of 1977, issued by Ministry of Finance because they are still in force. Accordingly all retirement benefits shall have to be calculated on last pay drawn. The gimmicks of committed by the management in offering lump sum pension has been checked and has been found to be a fraud because the amount paid was a fraction of each person's actual balance. They exploited our poor financial condition, sheer and emergent needs and general despondency(pessimistic out look in some) to their advantage. They actually laid a trap and some of us walked right in to it. But a number of us challenged the scheme and wanted to know if SBP or M*F had allowed it. No response was ever received. Matter was also complained to Governor SBP in 2015. This issue has discussed in a number of fora and every where the authorities accepted our point of view. That is why SBP was ordered to conduct an audit of ABL's Pension fund, other than the fraudulent misappropriations in it.
One by one we shall Insha Allah take them to task and recover all our rightful dues in whatever form usurped.

We are receiving cotinuous calls from our ABL Pensioner Friends whether those who accepted Lumpsum Pension on the offer of Bank during the years 2014 to 2016 can claim their Pensions / Arrears now?

Surely they can.

Reasons:-

ABL Pension Rules / Fund are recognizedone and any changes were / are subject to approval by Commissioner Income Tax (CIT).

On our complaint with Tax Mohtasib, CIT has confirmed having not approved any changes since 1992 I.e., other than approval of Pension / Fund Rules.

ABL Pension Fund is a Trust (AMANAT) with present management who took over the Bank during year 2004 whereas, Bank froze the Pensions during the year 2002 when it was a Government controlled Bank through MF and SBP. Hence, ABL is no more owner of this Fund.

One Mr. Zabarqan Zabri filed complaint / challenged with the WM against illegal offers of Lumpsum pension and WM has decided the case in his favour.

As per my information, now ABL has stopped this scheme, which does mean that they were doing iĺlegal practice.

ABL Pension Fund is a Trust and its Funds cannot be used other than Pensioners and SBP is inspecting / investigating this issue on the order of the WM.

ABL just to avoid the decision of WM has filed a Writ in LHC which is under trial.

So, please provide information as called and believe on Rehmat of Allah Taala.

Few days earlier I informed to respected members that, CJP has taken suo moto action regarding non implementation of various court orders / judgements of pension petitions and fixed the case on 14-11-2016.
We r trying to get attested copies of the case and then to consult with our legal advisor that how can we become party in this case.
Besides the above case there r number of other cases pending before various courts mentioned below.
Peshawar high court civil suit titled Dr Habib ur Rehman vs Abl fixed for argument 14-11-2016.
Civil suit titled Zaffar Khan vs ABL PHC for argument on the same date.
WP titled Badar uz Zuh and other vs ABL fixed on 13-11-2016' for argument before PHC Circuit bench Abbottabad
Two writ petitions before LHC fixed on22-11-2016.
Writ petition IHC is fixed on 17-11-2016.
Other then above two case one before IHRC Islamabad is also in progress, besides ombudsman case. In all above cases lawyers have been engaged and fee paid to them. But these expenses are being managed by few members.
Where as most of the retirees are following the policy of wait and see. This is not fare. We should be serious towards our cause, and must participate practically. Suo motor case needs at least Rs. 700000/-. I request to all that contribute maximum specially retired Executives and those who are on the edge of service and vil b standing in our row soon should participate in this cause. I am not in favour to bound any individual to pay certain sum as many of us may not b in good financial position but those who can bear the load of other members also must come forward. However if Rs. 5 to 6 thousands is donated the fee amount can be managed.
