ریمانڈ کیا ہوتا ہے؟

سب سے پہلی تو بات یہ ہے کہ ریمانڈ سے متعلق تفصیلات جاننے کے لئے آئین میں درج ضابطہ فوجداری کی دفعات61، 167 اور344 کا مطالعہ بہت ضروری ہے۔

اس کے ساتھ دفعہ62 اور دفعہ173 کا بھی مطالعہ کرنا چاہئے۔۔

ریمانڈ کے لفظی معنی ”واپس بھجوانا“ ہے۔

یعنی مجسٹریٹ کی عدالت سے مقدمہ میں نامزد پیش کردہ ملزم کو واپس حوالات بھیجنا

اصل میں پولیس کے تشدد کی وجہ سے یہ اصطلاح بہت خطر ناک سمجھی جاتی ہےجو کافی حد تک صحیح ہے۔
جب کوئی شخص کسی بھی جرم میں گرفتار ہوتا ہے تو پولیس اس کو چوبیس گھنٹے کے اندر مجسٹریٹ کے پاس پیش کرنے کی پابند ہوتی ہے اور مزید عرصے کے لئے زیر حراست رکھنا مطلوب ہو تو پولیس مجسٹریٹ سے تحریری حکم حاصل کرتی ہے اس درخواست کو ریمانڈ کی درخواست کہتے ہیں۔

اگر پولیس24 گھنٹے کے اندر ملزم کو عدالت میں پیش نہیں کرتی اور مزید مناسب حکم حاصل نہیں کرتی تو چوبیس گھنٹے سے بعد کی حراست غیر قانونی شمار ہوگی۔
عام طور پر ریمانڈ کی درخواست علاقہ مجسٹریٹ کو دی جاتی ہے تاہم ناگزیر صورت میں ریمانڈ کی درخواست کسی بھی مقامی مجسٹریٹ کو دی جا سکتی ہے۔ مجسٹریٹ جس کے روبرو کسی ملزم کو بغرض ریمانڈ پیش کیا جائے زیادہ سے زیادہ پندرہ دن کا ریمانڈ دیتا ہے۔ ہائی کورٹ رولز میں بھی ریمانڈ کے متعلق احکامات اور ہدایات دی گئی ہیں۔ ریمانڈ کی درخواستوں میں قانون یہ ہے کہ مجسٹریٹ کو ملزم کے وکیل یا اسکے رشتہ داروں کو یہ حق دینا چاہئے کہ اگر وہ ریمانڈ کے خلاف ملزم کی طرف سے عذر پیش کرنا چاہتے ہیں تو کر سکتے ہیں۔ ہائی کورٹ کے قواعد میں درج ہے کہ مجسٹریٹ کو لازم ہے کہ وہ ملزم کو وکیل رکھنے کا موقع دے تاکہ وہ وکیل ریمانڈ کے خلاف عذر پیش کر سکے۔

مجسٹریٹ کے لئے ضروری ہے کہ وہ اس بات کا تعین کرے کہ آیا ملزم کا پولیس کے قبضہ میں دیا جانا ضروری ہے یا نہیں۔اگر مجسٹریٹ محسوس کرے کہ ملزم کو پولیس کی حراست میں مزید رکھنا ضروری نہیں ہے تو وہ ریمانڈ کا حکم صادر کرنے سے انکار کر سکتا ہے۔

وہ ملزم جس کے خلاف مقدمہ زیر تجویز ہو ریمانڈ پر صرف پولیس اسٹیشن میں رکھا جا سکتا ہے کسی اور جگہ نہیں ورنہ یہ اقدام غیر قانونی ہوگا۔ریمانڈ کے لئے ضروری ہے کہ ملزم کو مجسٹریٹ کے روبرو حاضر کیا جائے۔ مجسٹریٹ کا خود مقامنظر بندی تک جانا غیر قانونی ہے۔
ملزم کے رشتہ داروں کو دوران ریمانڈملزم کو کھانا یا لباس مہیا کرنے سے بھی منع نہیں کیا جا سکتا۔
اب آتے ہیں ریمانڈ کی اقسام کی جانب تو جناب
ریمانڈ دو طرح کا ہوتا ہے۔
1۔ جسمانی ریمانڈ (physical remand)

2.جوڈیشل ریمانڈ
(judicial remand)

جسمانی ریمانڈ کا مطلب یہ ہے کہ گرفتار شدہ ملزم تھانہ میں ہی زیر حراست رہتا ہے۔ مجسٹریٹ اگر اس نتیجے پر پہنچے کہ پولیس کو بر آمدگی وغیرہ یا کسی اور مقصد کے لئے ملزم کی بنفسہ ضرورت ہے تو وہ ملزم کا جسمانی ریمانڈ وقتاً فوقتاً پولیس افسران کو دیتا رہے گا۔ لیکن اس ریمانڈ کی مجموعہ تعداد پندرہ دن سے زیادہ نہیں ہوتی۔ اس جسمانی ریمانڈ کی وجہ بھی باقاعدہ درج کی جائے گی
اس جسمانی ریمانڈ کا مطلب ویسے ہماری عام عوام میں پولیس کا ملزم پر تشدد ہی سمجھا جاتا ہے حالانکہ قانون کا یہ منشا ہر گز نہ ہے۔
مگر یہ بھی حقیقت ہے کہ تفتیش کا مطلب مار پٹائی کے سوا ہمارے ملک میں اور کچھ نہیں ہے۔ پولیس جس طرح دوران ریمانڈ ملزم کے ساتھ سلوک کرتی ہے وہ مہذب قوموں کے لئے لمحہ فکریہ ہے۔ اس رویے کی بناء پر پولیس کو خوف اور نفرت کی علامت سمجھا جاتا ہے۔ گرفتار شدہ شخص کے دوست، رشتہ دار صرف اس بات کے لئے پولیس کو بھاری رقوم بطور بطوررشوت دیتے ہیں کہ وہ ملزم کا جسمانی ریمانڈ نہ لے بلکہ جوڈیشل ریمانڈ لے اور مدعی پارٹی پولیس کو بھاری رقم اسی لئے دیتی ہے کہ وہ دوران ریمانڈ ملزم پر جسمانی تشدد کرے۔
گرفتار ملزم پر اگر دوران حراست تشدد کیا گیا ہے تو علاقہ مجسٹریٹ سے میڈیکل کرانے کا حکم حاصل کیا جا سکتا ہے تاکہ پولیس کی طرف سے کیا گیا تشدد ثابت ہونے پر پولیس کے خلاف کاروائی کی جا سکے۔
اب آتے ہیں جوڈیشل ریمانڈ کی جانب
2۔ جوڈیشل ریمانڈ (judicial remand)

جوڈیشل ریمانڈ کا مطلب ملزم کو سیدھا جیل بھجوانا ہوتا ہے۔ اگر پولیس آفیسر استدعا کرے کہ تفتیش مقدمہ مکمل ہے یا مزید تفتیش کی ضرورت نہیں ہے تو مجسٹریٹ ملزم کو عدالتی ریمانڈ(judicial remand) پر جیل بھجوا سکتا ہے۔
ایک صورت یہ بھی ہو سکتی ہے کہ اگر تفتیشی افست مزید ریمانڈ جسمانی کی استدعا کرے تو مجسٹریٹ مزید ریمانڈ جسمانی(physical remand) کی اجازت دینے سے انکار کرتے ہوئے ملزم کو عدالتی ریمانڈ پر جیل بھجوا سکتا ہے۔ اس کے لئے مجسٹریٹ چند امور کو مد نظر رکھے گا۔

1۔ مجسٹریٹ اگر مناسب سمجھے کہ تفتیش مقدمہ مکمل ہے۔

2۔ مجسٹریٹ اگر مناسب سمجھے کہ مزید تفتیش کی غرض سے جسمانی ریمانڈ دینا مناسب نہیں ہے۔

3۔ ملزم کے خلاف بظاہر کوئی مقدمہ نہ بنتا ہو۔

جسمانی ریمانڈ سے متعلق ہائی کورٹ کی ہدایات یہ ہیں کہ اسے بہت ہچکچاہٹ کے ساتھ منظور کرنا چاہئے اور تھوڑے تھوڑے دن کے لئے کرنا چاہئے۔ ضابطہ فوجداری کی دفعہ 167 اس بابت تفصیل فراہم کرتی ہے۔ عام لوگ چونکہ یہ خیال کرتے ہیں کہ ریمانڈ کی منظوری اور نا منظوری پولیس کی مرضی پر منحصر ہے اسلئے کوئی بھی ریمانڈ کے مرحلہ پر کسی وکیل سے رجوع نہیں کرتا۔ پولیس کے ٹاؤٹوں سے کام چلایا جاتا ہے حالانکہ ریمانڈ کے مرحلہ پر وکیل بحث کرکے مندرجہ ذیل قسم کے احکام حاصل کر سکتا ہے۔
1۔ جسمانی ریمانڈ کی بجائے جوڈیشل ریمانڈ کیا جائے۔
2۔ ملزم کی ضمانت لے لی جائے۔
3۔ ملزم کے خلاف ثبوت نہیں ہے اسکو رہا کر دیا جائے.
وکیل یہ عذر بھی لے سکتا ہے کہ جسمانی ریمانڈ کم دنوں کا دیا جائے۔
یہ بھی عام مشاہدہ ہے کہ گرفتار شدہ لوگوں کے وارث اس غلط فہمی کا شکار ہیں کہ ریمانڈ کے متعلق معاملات میں وکیل کوئی دخل نہیں دے سکتا اسی لئے وہ پولیس کے دلالوں کو ہزاروں روپے صرف اتنی سی رعایت کے لئے دے دیتے ہیں کہ جسمانی ریمانڈ نہ لیا جائے۔ سادہ لوح لوگوں کی غلط فہمی اور قانون سے لاعلمی کی وجہ سے پولیس کے لئے کرپشن کے کئی دروازے کھل جاتے ہیں۔ اس بابت تدارک کے لئے وکلاء اور عدلیہ کو اپنا کردار ادا کرنا ہوگا۔

غیر قانونی ریمانڈ
عدالت کو ریمانڈ دینے کی وجوہات اپنے حکم میں لکھنا ہوتی ہیں۔اسکا بہترین حل یہ ہے کہ آپ جوعذر پیش کرنا چاہتے ہیں وہ تحریری درخواست کے زریعے ریمانڈ کے وقت پیش کردیں۔ کوئی بھی جوڈیشل مجسٹریٹ ان عذرکو نہ تو پھاڑے گا اور نہ ان کو نظر انداز کرے گا یعنی حکم میں اگر ان کا ذکر نہ کرے گا تب بھی قابل مواخذہ ہوگا اور اگر عذرکی تردید میں بھی کچھ نہیں لکھے گا تب بھی جوابدہ ہوگا۔ ہائی کورٹ کو بڑی سختی کے ساتھ ایسے مجسٹریٹ صاحبان کی گرفت کرنی چاہئے جو ہائی کورٹ کے قواعد و ہدایات اور سکرول کو نظر انداز کریں۔ اب قانون میں ترمیم کرکے یہ حکم بھی ہو چکا ہے کہ ہر ریمانڈ کی نقل سیشن جج صاحب کو بھیجی جائے۔
ہائی کورٹ کو یہ واضح ہدایات ہیں کہ سیشن ججز صاحبان پر لازم ہے کہ وہ ناجائز قسم کے احکام ریمانڈ سے متعلق ہائی کورٹ کو رپورٹ بھجوائیں۔ بہر حال جب بھی کوئی متاثرہ فریق محسوس کرے کہ مجسٹریٹ صاحب نے ریمانڈ منظور کرتے ہوئے قانون کے مطابق عمل نہیں کیا تو فوراً اس کی نقل لے کر سیشن عدالت میں نگرانی دائر کر سکتے ہیں۔ اگچہ ایسی نگرانی کوئی زیادہ فائدہ مند نہیں ہوگی لیکن مجسٹریٹ صاحب سے حکم ریمانڈ کی بابت جواب طلبی ہو سکتی ہے۔
ایسے کئی فیصلے ہیں جن میں صرف ریمانڈ کے خلاف ہدایات دینے پر مجسٹریٹ صاحب کی جوابدہی ہوئی۔ اگر ایسی صور ت درپیش ہو تو براہ راست ہائی کورٹ میں بھی درخواست زیر دفعہ 491 ض۔ف دی جا سکتی ہے کہ ریمانڈ ہائی کورٹ کی ہدایات کے خلاف منظور کیا گیا ہے اسلئے حراست ملزم ناجائز اور نامناسب ہے۔ ایسی صورت میں ملزم زیر ریمانڈ کو رہا کردیا جائے گا۔
491 ضابطہ فوجداری illegal custody اورimproper custody دونوں صورتوں میں ہائی کورٹ مداخلت کرتی ہے۔جب ریمانڈ جوڈیشل کی بجائے جسمانی دیا گیا ہو تو اسے illegal نہ سہی improper custody کہا جا سکتا ہے اور491 ضابطہ فوجداری چونکہ سستا قانونی حربہ ہے اس سے فائدہ اُٹھایا جا سکتا ہے۔ ریمانڈ کے دوران بھی ملزم کو قانوناً یہ حق حاصل ہوتا ہے کہ اس کے دوست احباب اور وکیل اس سے ملاقات کریں اور اس کوقانون کے مطابق صحیح مشورہ دیں۔ملزم کے بارے میں کہا جاتا ہے کہ: accused is the favourite child of law اسلئے یہ تمام سہولیات قانون کے مطابق ملزم کو ملنی چاہئیں۔
قانونی تقاضہ یہ ہے کہ ملزم کو تھانے کی عمارت میں رکھا جائے۔ کئی تھانیدار تشدد کرنے کے لئے پرائیویٹ مکان حاصل کرکے ملزموں کو ایسے پرائیویٹ مکانوں میں رکھتے ہیں جو سراسر غیر قانونی ہے۔اس کے علاوہ ان کو بھی جن کی گرفتاری ریکارڈ میں موجود نہیں ہوتی انہیں بھی ایسے ٹارچر سیلز میں رکھا جاتا ہے۔ لہذاایسے مکانوں پر چھاپہ ڈلواکر تھانیدار کے خلاف پرچہ درج کروایا جا سکتا ہے۔
سی آئی اے کا دفتر تھانہ نہیں ہوتا،اسی طرح کرائم برانچ کا دفتر بھی تھانہ نہیں ہوتا اسلئے ملزمان کو سی آئی اے کے دفتر میں رکھنا خلاف قانون سمجھا جائے گا۔
منطقی طور پر یہ بات سمجھ لینی آسان ہے کہ جب قانون نے ملزم کو یہ حق دیا ہے کہ وہ گرفتاری کے بعد اپنے گھر سے بستر اور کپڑے منگوا سکتا ہے، دوست احباب اور وکلاء سے ملا قات کر سکتا ہے تو یہ سب قانونی حقوق ایسی حالت میں کیونکر پورے ہونگے جب ملزم کو کسی خفیہ مقام پر پابند رکھا جائے۔

ہائی کورٹ کے بیلف 491 ضابطہ فوجداری کی درخواستوں پر چھاپہ مارتے ہیں تو سب سے پہلے وہ روزنامچہ قابو کرتے ہیں جہاں رپٹ گرفتاری عموماً لکھی ہوئی نہیں ہوتی بلکہ تھانیدار بیلف کے چھاپے کے بعد کسی مقدمے کی ضمنی میں گرفتاری کا ذکر کر دیتا ہے۔تھانے کے روز نامچے کا رجسٹر سب سے زیادہ قابل اعتبار ریکارڈ ہوتا ہےاس میں ردو بدل آسان نہیں ہوتا...!!..
