عدالت نے موٹروے گینگ ریپ کے دونوں مجرموں کی سزائے موت کےفیصلے کےخلاف اپیلیں مسترد کردیں

مرکزی مجرم عابد ملہی اور شفقت بگا نے سزا کے خلاف اپیلیں دائر کر رکھی تھیں

جسٹس سید شہباز علی رضوی پرمشتمل بینچ دورکنی بنچ نےمحفوط فیصلہ سنادیا

عدالت نے فریقین کے وکلا کے دلائل مکمل ہونے پر فیصلہ محفوظ کیاتھا

انسدادِ دہشت گردی عدالت نے دونوں مجرموں کو سزائے موت سنائی تھی

لاہور کی انسدادِ دہشت گردی عدالت نے 20 مارچ 2021 کو سزا کا حکم دیا تھا

دونوں مجرموں کو زیادتی اور دیگر سنگین دفعات کے تحت سزائے موت سنائی گئی تھی

Pre Arrest Bail in 448, 440, 511, 427 PPC

The Supreme Court granted pre-arrest bail to the petitioner under Section 497(2) Cr.P.C., holding that the case called for further inquiry. The Court observed that the parties were closely related and involved in an ongoing dispute concerning a housing society established by the petitioner’s late father, making the possibility of false implication and mala fide on the part of the complainant difficult to rule out. The matter was also a case of cross-versions, as the petitioner alleged that the complainant party was the aggressor and that his side had a lawful right to enter the housing society as its owners. Furthermore, although the FIR alleged that a passerby had sustained injuries due to the accused persons’ firing, no proper investigation was conducted by the police regarding the alleged injury. In these circumstances, the Court held that the case fell within the ambit of further inquiry under Section 497(2) Cr.P.C. and consequently allowed the appeal and confirmed pre-arrest bail.

Petitioner was found to be carrying the artificial milk from one place to another by means of a vehicle/tanker, as such I am confident to hold that he (petitioner) was transporting the milk, therefore, shall be squarely covered by the purview of “food operator”.

Synthetic Milk that is also called Sweet Poison is not the milk but an artificial imitation of natural milk with a high degree of adulteration to increase the volume of milk. Main components of Synthetic Milk are water, pulverized detergent or soap, sodium hydroxide, vegetable oil, salt and urea. Although it does not kill at once but it slowly makes the body a fertile ground or farm house for diseases. According to research, use for Synthetic Milk inflicts very serious harms on human body causing swelling in the eyes and complications in lever and kidney.
