📌 One-Line Citation Description

📘 Definitions of Legal Concepts
⛔️ Abandonment of Witnesses by Prosecution
⛔️ Right of Defence after Alteration of Charge
⚖️ Definitions of Sections & Laws
⛔️ Section 540, Code of Criminal Procedure (V of 1898):
⛔️ Sections 302, 324, 337-F(vi) & 34, Pakistan Penal Code (PPC):
📖 Background of the Case
⚖️ Core Legal Questions
🏛️ Court's Observations & Legal Principles
⚖️ Final Order
📑 Ratio Decidendi
💼 Practical Utility for Advocates
🎯 Quotable Legal Principle
"Section 540, Cr.P.C has two parts; the second part is mandatory in nature making it obligatory on the part of a Court to summon and examine any person if his evidence appears to be essential for the just decision of the case, notwithstanding that the prosecution had abandoned such witnesses."

Criminal Procedure Code (V of 1898)---
----S. 540---Penal Code (XLV of 1860), Ss. 302, 324, 337-F(vi) & 34---Summoning of witnesses---Scope---Application of accused for summoning of witnesses in defence was dismissed---Validity---Admittedly, both the witnesses had been shown as the eye-witnesses of the occurrence---Said witnesses were shown as witnesses of the prosecution in the final report (challan)---Prosecution had abandoned the said witnesses on 22.08.2022 for the reason that they were strangers and they had been won over by the petitioners/accused---Although, the petitioners/accused in their statements recorded under S.342, Cr.P.C., on 25.10.2022 and on 09.01.2023, didn't prefer to avail the opportunity of producing evidence in defence, however, in the latter statements petitioners/accused availed the opportunity of recording statements on oath---Latter statement had been recorded after alteration in the charge against them on 12.12.2022---Perusal of the altered charge would show that when asked about the production of evidence in defence, they replied in the negative but added that they might have done so if it was deemed necessary after the closing of the prosecution evidence---Two significant aspects of the matter inhand were that; firstly, both the witnesses had been shown in the FIR as the eye-witnesses of the occurrence---Said fact being so, perhaps the Trial Court could have summoned them as Court witnesses for the just decision of the case---Secondly, though the prosecution closed its case, the Trial Court had yet to examine the petitioners/accused on oath under S.340(2), Cr.P.C. and to hear the arguments of the parties before announcing the judgment---Section 540, Cr.P.C, related to the power of the Court to summon material witness or examine the person present before it---Said provision had two parts, first part vested in the Court the discretionary power to summon anyone as a witness or examine any person who was present though was not summoned as a witness---Second part which was mandatory in nature made it obligatory on the part of a Court to summon and examine or recall and re-examine any such person if his evidence appeared to be essential for the just decision of the case---As the witnesses concerned had been shown in the FIR as the eye-witnesses of the occurrence, therefore, their evidence appeared to be essential for the just decision of the case---In the instant case, the examination of the two witnesses did not appear to be vexatious, as they had already shown as eye-witnesses of the occurrence---Moreover, such examination was not likely to cause delay in the conclusion of the trial---Criminal revision petition was allowed, accordingly.
