SC Clarifies: Equal Protection Does Not Mean Identical Treatment

In this case, Mr. Jesus challenged the constitutionality of Republic Act No. 9262 (Anti-Violence Against Women and Their Children Act). He argued that the law violated the Equal Protection Clause because it grants special remedies only to women and their children, while similarly situated men who may also suffer domestic violence are not given the same protection.

The SC En Banc disagreed and reiterated:

"The equal protection of the laws clause of the Constitution allows classification x x x. A law is not invalid because of simple inequality. x x x All that is required of a valid classification is that it be reasonable, which means that the classification should be based on substantial distinctions which make for real differences; that it must be germane to the purpose of the law; that it must not be limited to existing conditions only; and that it must apply equally to each member of the class."

SC CLARIFIES: PARENTAL DISCIPLINE BECOMES CHILD ABUSE WHEN PUNISHMENT IS EXCESSIVE AND DEGRADING

The Supreme Court has clarified that while parents have the right to discipline their children, that right is not absolute. When the punishment employed is excessive, violent, and disproportionate to the child's misconduct, it may constitute child abuse punishable under Republic Act No. 7610.

Hitting a child several times with a wooden rod embedded with a nail, pulling a child's hair, kicking, striking the head, and repeatedly beating another child with a dustpan were extreme forms of punishment that could not be considered reasonable parental discipline. These acts, the Court ruled, demonstrated an “intent to debase, degrade, and demean the children's intrinsic worth and dignity.”

CHILDREN BORN OUTSIDE MARRIAGE SHOULD BE CALLED “NON-MARITAL,” NOT “ILLEGITIMATE”

"[A]s used under Article 165 of the Family Code, are "[c]hildren conceived and born outside a valid marriage[.]" The phrase "outside a valid marriage" does not necessarily mean an extramarital affair. Parents may choose not to get married despite having no legal impediment to marry. x x x Another reason why a child could have been born "outside a valid marriage" is because their mother was a victim of se*xual ass*ault who did not marry the perpetrator."
