SC En Banc: Parents Primarily Liable for Minor’s Gun-Related Crime, Not Merely Subsidiary
The Supreme Court (SC) En Banc held that parents are [p]rimarily and directly liable for damages caused by their minor children, whether arising from crimes or quasi-delicts, unless they prove that they exercised the diligence of a good father of a family. The Court affirmed liability in this case because the parents failed to properly supervise their son and negligently allowed him access to a fi***rm, which he used to kill his former girlfriend before taking his own life.
