🥒 Pwede ba ma-liable ang pickleball player kung iyang gi-smash ang bola diretso sa nawong sa laing player?

Yes—possibly. Under Article 2176 of the Civil Code, possible ang liability if ang shot was done negligently or recklessly, nakapahinabo og injury, ug ang maong action mao ang proximate cause sa injury.

Pero dili pasabot nga basta maigo ka sa bola, automatic liable na dayon ang other player. Tan-awon gihapon ang circumstances, like:

📍 Unsay distance sa duha ka players?

💨 Unsa ka kusog ang shot?

🎯 Asa padulong ang bola?

⚠️ Unsa ang applicable safety rules?

🏓 Normal risk ba gihapon siya sa game, or ni-exceed na sa ordinary risks sa pickleball?

Kung ang injured player negligent pud, possible nga ma-reduce ang damages. And in certain circumstances, mahimong ma-bar ang recovery kung ang iyang negligence mismo ang immediate and proximate cause sa injury.

📌 Bottom line: Dili automatic nga liable ang player tungod lang kay naigo ang opponent. The facts and circumstances matter.

We’re happy to share that our own Atty. Rolando III G. Arcenal served as Supervising Lawyer during the Clinical Legal Education Program (CLEP) of the Liceo de Cagayan University – College of Law, held at Barangay Macabalan.

The activity provided an opportunity for our Law Student Practitioners to share practical legal knowledge with the community, particularly on Katarungang Pambarangay and the Safe Spaces Act.

We are proud to support initiatives that bring legal education closer to the people and help future lawyers develop not only their legal skills, but also their commitment to service and access to justice.

🏘️ What Cases Can HSAC Handle Involving Subdivisions and Condominiums?

Nagpalit ka ug subdivision lot or condominium unit, pero naa kay dispute with the developer? HSAC might be the proper forum for your case.

Under Section 16 of Republic Act No. 11201, the HSAC Regional Adjudicators have original and exclusive jurisdiction over certain disputes involving subdivisions, condominiums, memorial parks, and similar real estate developments.

These include cases involving:

🔹 Unsound real estate business practices
🔹 Refunds and other claims of subdivision lot or condominium unit buyers
🔹 Specific performance of contractual and statutory obligations
🔹 Disputes involving open spaces and common areas
🔹 Declaration of abandoned real estate developments
🔹 Easement disputes within or among subdivision projects
🔹 Annulment of certain mortgages executed in violation of the Subdivision and Condominium Buyers’ Protective Decree

In short, dili tanan property disputes diretso sa regular courts. Some disputes involving real estate developments fall within the jurisdiction of the Human Settlements Adjudication Commission (HSAC).

Law School: Healing Ground or Helling Ground? ⚖️

Law school was arguably one of the most difficult undertakings I have ever taken on, but somehow, it healed me in more ways than one.

After spending over a decade in the corporate world, climbing the ladder, receiving promotions, and holding leadership positions, I somehow found myself feeling empty despite all the professional milestones.

Then came law school.

It was exhausting. It was humbling. It tested my patience, my finances, my relationships, and whatever was left of my sanity. 😂

But somewhere along the way, I found something I did not know I was looking for.

The shared trauma with my classmates, the sleepless nights, the recitations we thought would end us, the exams that made us question every life decision, and all the chaos we went through together are now stories we laugh about whenever we get together.

Maybe that is what makes law school special. Sometimes, the very things that break you also become the memories that shape you.

So, if you are in your thirties or on the verge of a midlife crisis, and you have not yet entered your pickleball, running, or HYROX era… 😂

Maybe the law school era is meant for you.

It might be your healing ground.

Or your helling ground. 😆

Either way, you might just come out of it as a different person.

⚖️ **HSAC SERIES | EPISODE 2**
🏘️ **The Basic Jurisdictional Test**

**“HSAC ba ni nga kaso?”** Before filing, ayaw dayon ug assume. Check first if the dispute actually falls within the jurisdiction of the **Human Settlements Adjudication Commission (HSAC).**

Sa simple nga pagsabot, **tulo ka butang ang atong tan-awon:**

1️⃣ **Unsa ang nature sa dispute?**
2️⃣ **Unsa nga property or project ang involved?**
3️⃣ **Kinsa ang mga parties?**

Importante: **Dili ang title sa complaint ang magbuot kung HSAC ba ang proper forum.** What matters are the **allegations, the cause of action, the property or subject matter involved, the parties, and the relief being sought.**

Generally, the dispute must involve matters covered by law, such as **subdivision projects, subdivision lots, condominium projects or units, memorial parks, similar real estate developments, or homeowners association matters.**

👉 **Before you file, ask: “HSAC ba gyud ni?”**

Because in litigation, **filing in the wrong forum can affect the entire case.**
