Warrantless arrest may be lawful when:

CHANGE OF NAME: KAILAN AT PAANO ITO MAGAGAWA?

⚖️ PERMANENT DISMISSAL: JUSTICE CAN, INDEED, BE SWIFT.

Another case successfully concluded by CPI Law, this time with the permanent dismissal of a criminal case against our client.

After the case was revived on March 2026, the prosecution was given opportunities to present its evidence. However, its listed and essential witness, the private complainant, repeatedly failed to appear.

During the scheduled presentation of prosecution evidence (3rd hearing), the private prosecutor manifested that the prosecution could no longer locate and produce the private complainant to testify. The defense, through Atty. C, moved for the permanent dismissal of the case and firmly maintained that our client was not amenable to a mere provisional dismissal.

The Honorable Court granted the defense's motion.

In its Order dated September 1, 2026, the Court recognized that the prosecution had not presented its sole and essential witness and had not presented evidence capable of establishing the accused's guilt beyond reasonable doubt within the periods provided under the rules on continuous trial.

The Court likewise emphasized the constitutional right of the accused to a speedy trial, and ultimately ordered:

“PERMANENTLY DISMISSED.”

JUSTICE DOES NOT ALWAYS HAVE TO TAKE YEARS.

We are particularly grateful to the Honorable Trial Court for its firm and conscientious handling of this case and, importantly, for leveraging technology in the service of justice.

The electronic transmission of Orders and other court issuances, coupled with the parties' consent to electronic service, significantly facilitated communication and allowed the proceedings and subsequent disposition to move efficiently.

For us at CPI Law, this is a concrete reminder that technology, when properly integrated into the judicial process, can help make justice more accessible, efficient, and, yes, swift.

Every accused person is entitled to the constitutional guarantee of a speedy trial.

And every court that finds ways to responsibly use technology to move cases forward deserves recognition.

At CPI Law, we remain committed to vigorous, principled, and strategic advocacy for our clients, while respecting the independence and authority of our courts.

🚨 JURISPRUDENTIAL UPDATE | BP 22: NOTICE OF DISHONOR MAY NOW BE SERVED ELECTRONICALLY

The Supreme Court has clarified the rules on the service of the Notice of Dishonor in cases involving Batas Pambansa Blg. 22 (Bouncing Checks Law).

YES, service may now be made through electronic means—including:

📧 Email
💬 Viber
💬 Facebook Messenger
📲 Other comparable digital messaging platforms

But there are important safeguards.

1️⃣ Electronic service may be PRIMARY service

Electronic service may be used as the primary mode when the drawer's email address or electronic contact details were made available to the payee through official communications.

2️⃣ Electronic service may be SUBSTITUTED service

When personal service is not practicable, electronic service may be resorted to, such as when the drawer:

▪️ Deliberately evades service;
▪️ Refuses to receive the Notice of Dishonor;
▪️ Unreasonably delays acknowledgment; or
▪️ Causes the notice to be received by an unauthorized person.

3️⃣ The electronic contact details must be reasonably verified

It must be shown that the email address, account, or mobile number actually belongs to and is actively used by the drawer or an authorized representative.

This may be established through:

✔️ Prior messages regarding the same transaction;
✔️ Prior confirmation of the email address or number;
✔️ Previous use of the same account to send instructions or acknowledgments; or
✔️ Contact details appearing in checks, contracts, loan documents, or other records attributable to the drawer.

4️⃣ For substituted electronic service, timing is crucial

The electronic communication must:

📎 Attach or enclose the Notice of Dishonor;
📝 State the prior unsuccessful attempts at personal service; and
📱 Inform the recipient that electronic service is being resorted to because personal service failed.

Importantly, it must be made within 24 hours from the final attempt at personal service.

5️⃣ An AFFIDAVIT OF SERVICE is now mandatory

Whether service is made personally or electronically, the person who effected service must execute an affidavit under oath, with supporting proof.

For electronic service, the evidence should include, among others:

📌 Date and time of sending;
📌 The actual email or message transmitting the notice;
📌 The email address, account, or number used;
📌 Delivery or read receipts, if available; and
📌 Exported chat history or conversation files, where the platform allows.

⚖️ IMPORTANT: A mere denial by the drawer—such as "Hindi ko nabasa" or "Hindi ko natanggap"—will not automatically invalidate electronic service.

📣 TAKEAWAY FOR LAWYERS, CREDITORS, AND BUSINESS OWNERS:

Save your messages. Preserve your screenshots. Export your chats. Keep proof of delivery. Execute the proper affidavit.

In today's digital transactions, the Notice of Dishonor is no longer confined to physical delivery—but electronic service must strictly comply with the safeguards laid down by the Court.

Most importantly, proof of service is now indispensable.

✔️ Asawa
✔️ Dating asawa
✔️ Live-in partner
✔️ Dating live-in partner
✔️ Boyfriend o dating boyfriend
