🚨 New M**h Testing Regulations in NZ 🚨

Big changes have come into effect around m**hamphetamine testing in rental properties, giving clearer rules for both landlords and tenants.

Here’s what you need to know:

• A property is now considered contaminated if m**h levels are above 15µg per 100cm²

• If levels go above 30µg, the home can be considered uninhabitable and the tenancy can be ended quickly

• Professional testing is required in certain situations where contamination is suspected

• Clear rules now outline when to test, how to clean, and landlord responsibilities 

These new regulations aim to remove confusion, reduce unnecessary testing, and create a fair process for everyone involved.

1. If I conduct a screening test myself and get the result wrong, am I liable?
Potentially yes. Liability may arise if incorrect results are relied upon without verification using permitted m**hods or qualified professionals.

2. Can I be liable for using the wrong testing m**hod or kit?
Yes. Using unvalidated or non-permitted m**hods may be considered non-compliant and increase legal and insurance risk.

3. What level of due diligence is expected?
Property managers must understand the difference between screening and detailed testing and escalate to qualified professionals when thresholds are exceeded.

4. Does using an independent testing professional reduce my risk?
Yes. Independent, qualified testing demonstrates reasonable care and helps reduce liability exposure.

5. Should I review my professional indemnity or liability insurance?
Yes. Coverage should be reviewed to ensure m**h testing decisions, advice, and compliance risks are included.

1. When is m**h contamination a mandatory disclosure?

🏛️ GOVERNMENT & REGULATORY UPDATE – M**H CONTAMINATION STANDARDS

Draft regulations propose that:

Properties with residue greater than 15 µg/100 cm² will be classed as contaminated and must be remediated to ≤15 µg/100 cm².

Properties above 30 µg/100 cm² may be deemed uninhabitable, and tenancy termination options may apply.

🔬 Testing & Clearance Requirements

Screening assessments can be completed by landlords, tenants, or professionals.

Detailed testing is required where screening indicates >15 µg/100 cm² or where manufacture is suspected.

Post-decontamination testing must confirm contamination is ≤15 µg/100 cm².

🧹 Decontamination & Clearance
If contamination is confirmed, approved decontamination contractors must remediate affected areas.

📑 Disclosure Obligations
Results at or above the 15 µg/100 cm² threshold must be disclosed in property sales and new tenancies.
Real estate professionals, property managers, and landlords have legal duties to provide accurate information supported by verified testing reports.

🚨 Enforcement & Compliance
Councils will have authority to issue:

Cleaning orders

Repair notices

Reinspection requirements

Penalties

This ensures unsafe properties are addressed and remediation occurs within reasonable timeframes.

🚗 **IMPORTANT: DRUG DRIVING LEGISLATION CHANGES (Effective Dec 2025)**
New updates to the **Land Transport (Drug Driving) Amendment Act 2022** have strengthened how drug driving is tested and penalised in NZ.

🔹 **Key changes include:**
• New illegal drug limits and tougher penalties for 25 qualifying drugs (including m**hamphetamine).
• Defined “tolerance” and “high-risk” concentration levels — with higher penalties for mixing drugs or combining with alcohol.

As we continue growing M**h Xpert’s presence in the Wellington region, I’ve been meeting with local real estate professionals and property managers to build relationships and raise awareness about the risks of m**h contamination.

👉 One recent conversation really stuck with me.

After explaining what we do—independent m**h testing and non-certified educational presentations—a real estate manager told me:

❝ We haven’t needed to do m**h tests for years. It was a fad… and anyway, we only deal in upmarket properties. ❞

Honestly, that response was surprising—not scary, but telling. It showed a real gap in awareness. So let’s clear som**hing up:

"It's starting to creep into all families, from the parents to young m**hamphetamine users at age of eight or nine. They're getting younger," he said.

He was asked if seeing eight- or nine-year-olds using m**h was uncommon.

"No, it might have been a few years back but it's not an uncommon thing now."

M**hamphetamine use more than doubled between July and September 2021, and has stayed well above the historical average through to January this year, wastewater figures show.
