🚨 CAN SAPS ARREST YOU WITHOUT A WARRANT? 🚨

Many people believe that the police can only arrest you if they have a warrant. That is not always true.

In South African law, SAPS may arrest a person without a warrant in certain circumstances, including where:
✔️ A police officer reasonably suspects that you committed a serious offence
✔️ An offence was committed in the officer’s presence
✔️ The officer believes you may flee or interfere with an investigation

However, an arrest must still be lawful and justified. Police officers cannot simply arrest someone because:
❌ They are angry
❌ Someone pointed a finger without proper grounds
❌ “To teach you a lesson”
❌ There was no proper investigation

🔹 Wrongfully arrested
🔹 Unlawfully detained
🔹 Assaulted by police
🔹 Held in custody unfairly

you may have the right to institute a claim against the Minister of Police.

We are proud to share that our director, Mrs Yolanda Taljaard, recently attended the graduation ceremony of the SAJEI Brigette Mabandla Aspirant Women Judges Programme.

The graduation ceremony featured insightful addresses, including a keynote by the President of the Supreme Court of Appeal, Justice M B Molemela, who emphasised the importance of equipping women with the skills, confidence, and support needed to lead and shape a more equitable judiciary.

Esteemed speakers for the day also included Judge President Legodi and Judge Pillay, whose contributions highlighted the significance of mentorship, transformation, and excellence within the legal profession.

Mrs. Yolanda Taljaard: Championing Justice and Breaking Barriers

In 2025, Mrs. Yolanda Taljaard, Director of Van der Merwe Attorneys and Regional Court Magistrate, added another milestone to her already distinguished legal career: successfully completing the Aspirant Women Judges Programme (2024–2025), hosted by the South African Judicial Education Institute (SAJEI). Her achievement is not only a personal triumph but also a symbol of progress in gender equality in the judiciary.

The Aspirant Women Judges Programme is designed for female legal professionals — attorneys, advocates, or judicial officers — with significant experience (typically at least 12 years) in the legal field. The Programme combines rigorous selection, monthly training sessions, mentorship placements in various High Court divisions, and assessment via judgment-writing and interviews. Its aim is to prepare candidates to be favorably considered for judicial appointments, to serve as acting judges in high courts, and to contribute to the transformation and gender balance of the judiciary.

Mrs. Taljaard’s successful completion of this Programme signifies that she has not only met but excelled in a demanding process that tests both legal acumen and judicial temperament. Her completion places her among a group of committed legal professionals working to raise the bar for women in law.

She has undergone mentorship and placement in High Court Divisions — gaining exposure to judicial reasoning, decision writing, and courtroom processes. She has engaged with peer candidates and senior judges, expanding her network and deepening her understanding of the judiciary’s role in society.

With completing the Programme, Mrs. Taljaard enhances her credentials and positions her well for future roles, whether as an acting judge or possibly a permanent appointment. It reflects her commitment to excellence, ethical practice, and leadership in the legal profession.
