🚨 CAN SAPS ARREST YOU WITHOUT A WARRANT? 🚨
Many people believe that the police can only arrest you if they have a warrant. That is not always true.
In South African law, SAPS may arrest a person without a warrant in certain circumstances, including where:
✔️ A police officer reasonably suspects that you committed a serious offence
✔️ An offence was committed in the officer’s presence
✔️ The officer believes you may flee or interfere with an investigation
However, an arrest must still be lawful and justified. Police officers cannot simply arrest someone because:
❌ They are angry
❌ Someone pointed a finger without proper grounds
❌ “To teach you a lesson”
❌ There was no proper investigation

🔹 Wrongfully arrested
🔹 Unlawfully detained
🔹 Assaulted by police
🔹 Held in custody unfairly
you may have the right to institute a claim against the Minister of Police.
