Sometime ago in Nigeria, one company dragged another company to court for starting their own legal business and won the case.

This is what actually happened.

The first company had carried on business as chemists and druggists for some years and had several branches in Onitsha and other towns in Eastern Nigeria.

The firm was well known under the name of "Niger Chemists" and were properly registered with the Corporate Affairs Commission of Nigeria.

Another company founded a firm carrying on exactly the same business in Onitsha under the name of "Nigeria Chemists." which was similar to the first company's name; "Niger Chemists".

The first company (Niger Chemists) objected to this use of a name so similar to its own and requested the second company changed it but the second company (Nigeria Chemists) refused that request.

The first company ( Niger Chemists) brought proceedings to court for an injunction ( judgement) to restrain the defendants (second company) from using the name and style "Nigeria Chemists."

The court gave judgement in favour of the first company ( Niger Chemists). As it agreed that the name "Nigeria Chemists" is so similar to the name "Niger Chemists" and it's likely to confuse the public (mistake one for the other) and gave the plaintiff (Niger Chemists) an injunction (judgement) restraining the defendants (second company) from using that name or any other name closely resembling "Niger Chemists."
