If I collect loan and no fit pay, can loan app arrest me?

You must understand that owing a loan is generally a civil matter, not a criminal offence. A lender cannot use the police as a debt recovery agent just because you have not repaid a loan. The proper legal step is to take the debtor to court and ask for judgment for the unpaid principal, agreed interest, and any lawful charges. Nigerian consumer regulators have also warned digital lenders against abusive recovery methods, harassment, privacy violations, and other unlawful conduct.

That said, people should be careful not to overstate the position. Failure to repay a loan does not automatically mean arrest, but if there is a separate allegation of fraud, impersonation, forgery, or another actual criminal offence, the police may investigate that criminal aspect. What the police should not do is turn themselves into debt collectors for ordinary loan default.

Also, any repayment promise or settlement obtained through intimidation, unlawful detention, or police pressure is open to legal challenge. A police station is not the proper place to force parties into a debt settlement in an ordinary civil transaction. If a lender is truly aggrieved, the lawful route is to sue in court.

Another important point is this: many digital lenders in Nigeria are expected to comply with CBN and FCCPC rules and registration requirements, and the FCCPC publicly maintains lists and regulations for digital money lenders. So the issue is not that “loan companies cannot sue because many are not licensed.” Some can sue if they are properly operating, but they still must recover debts lawfully and cannot harass borrowers or violate consumer rights.

If a loan company starts threatening you, shaming you, contacting your friends unlawfully, or using abusive recovery tactics, you may have legal remedies against them. Know your rights, but also know your responsibility. Owing money is not a joke, and lenders too must obey the law.

But under the Criminal Code, any person wey unlawfully assaults another person commits an offence, and if the assault causes harm, the punishment fit be more serious. The law states that unlawful assault is a misdemeanor punishable, if no greater punishment is provided, with up to one year imprisonment, while assault causing harm is a felony punishable with up to three years imprisonment.

Many people for Nigeria still dey mix this matter up. Dem go say, “Na church wedding we do, no be court wedding.” But make we clear am well. If the marriage is celebrated under the Marriage Act, whether for registry or for a licensed place of worship, that one na statutory marriage. So church marriage fit still be statutory marriage if e follow the Marriage Act process and na licensed church wey celebrate am.

Why this one important? Because statutory marriage get stronger formal legal effect for both man and woman. E be monogamous marriage, meaning say once you marry under this system, you no suppose marry another wife or husband while that marriage still dey alive. Bigamy na offence under Nigerian law. So this one no be ordinary “ring and cake” matter. Na serious legal status wey carry rights and responsibilities join body.
