Mediation can be applied to various areas of law, as it is a flexible and effective method of alternative dispute resolution. Some of the common areas where mediation is used include:

1.Family law disputes, such as divorce, child custody and visitation, spousal support and division of assets.
2. Civil disputes such as personal injury cases, contract disputes, property disputes.

It is worth noting that Mediation may not be suitable for all cases, particularly those involving power imbalances, violence, or situations where immediate legal remedies are required.

1. SECTION 67(1) - This section provides that the Act will apply to both domestic and International commercial mediation proceedings. And in terms of enforcement, it will apply to domestic and international settlement agreements as well.

2. SECTION 70 - lists out the various ways in which Mediation proceedings can be initiated: by special statute as a condition before exploring other dispute resolution mechanisms, by sending an invitation to mediate to the other party which the latter must accept for successful initiation, during judicial or arbitral proceedings by agreement of parties, by a judicial, arbitral or administrative body already trying to intervene in the dispute.

3. SECTION 73 (5) - Online Dispute Resolution (ODR) in Mediation is now provided for by Law. The law provides that the parties and the mediator can agree to conduct any of the mediation sessions via electronic means such as video conference, etc.

4. SECTION 82 - This section of the law has finally laid to rest the debate about mediation being binding or not. In subsection 2, it states that mediation is binding and enforceable as a contract, consent award and as consent judgment.

5. SECTION 87 - International settlement agreements are enforceable in Nigeria, and the laws of the Convention on International Settlement Agreements Resulting from Mediation. This section will apply provided that the state is a party to the Singapore convention and whether the dispute arises from a legal relationship considered as “commercial” in Nigeria.
