Muhammed v. State
(2026) 8 NWLR (Pt. 2046) 417

KEY DECISION OF THE COURT

The Court held that:

“Where, in the course of trial, a charge or information is amended, a fresh plea must be taken from the defendant. Failure to take a fresh plea after such amendment renders the entire trial a nullity.”

LEGAL PRINCIPLE

An amended charge creates a new basis upon which the accused person is to answer the allegations against him. Consequently, the accused must be afforded the opportunity to plead afresh to the amended charge.

PRACTICE POINT

✓ Always ensure that a fresh plea is taken after any amendment to a charge or information.
✓ Trial courts must strictly comply with this requirement.
✓ Defence counsel should promptly object where a fresh plea is not taken.
✓ Such omission may provide a valid ground for appeal.

NBA ELECTIONS, LAWYERS NEED FLEXIBLE LOANS.

Don’t be the lawyer that boards the bus every morning to court, or at less try not to be that lawyer by making adequate use of the opportunity set up by the NBA.

The Enactment of the LEGAL PRACTITIONER REMUNERATION ORDER 2023 is an opportunity for all lawyers to reasonable avoid jumping the bus in the morning while rushing to court.

Your pristine white and dark suit, well polished shoes, collars and collarettes, bibs, wigs and gowns are so precious that they should be held with utmost reverence.
But why would a bus conductor/ driver or lay man regard you when you board their bus and with them.
Lawyers should in turn learn to utilize the Remuneration Order to properly charge their fees in order to further help them easily buy their own cars and live reasonably comfortable.

Don’t wish for a witness like mine.

So my case was slated for hearing on the next adjourned date.

I invited the witness to prep him on the things he should expect and need to follow through our case plan and to keep his answers short simple and striaght to the point.

We painstakingly and extensively went through the witness deposition paragraph through paragraph to explained to him how to answer questions and need for calm.
Under cross examination.

When the time came witness forgot all our discussions and kept opening lope holes for more questions that got him arguing with the my learned friend in the witness box.

I know his going to see this, just know that I am not happy with you I will have to patch what you did to my case which were avoidable.
