⚖️ WHAT YOU MUST PROVE BEFORE THE COURT CAN ADMIT YOUR WHATSAPP MESSAGE
You have the WhatsApp chat. You took a screenshot. You printed it out, But that alone may not be enough. WhatsApp messages are electronic evidence, and before the court admits them, the requirements of Section 84 of the Evidence Act 2011 must be satisfied.

WHAT MUST BE ESTABLISHED?
Before relying on a WhatsApp message produced from an electronic device, the relevant statutory requirements include showing that:
1️. The device was regularly used during the relevant period to store or process information.
2️. Information of the relevant kind was regularly supplied to the device in the ordinary course of the relevant activities.
3️. The device was operating properly during the material period, or any malfunction did not affect the accuracy of the electronic record.
4️. The information contained in the electronic record was derived from information supplied to the device in the ordinary course of those activities.
These are the conditions contained in Section 84(2) of the Evidence Act 2011

WHAT ABOUT THE CERTIFICATE OF COMPLIANCE?
This is another important requirement under Section 84(4) of the Evidence Act 2011. Where a computer-generated document is being tendered, the law provides for a Certificate of Compliance.
The certificate should, among other things:
1. Identify the electronic document being tendered.
2. State the manner in which the document was produced.
3. Give particulars of the device involved in producing the document.
4. Deal with the conditions contained in Section 84(2).
5. Be signed by a person occupying a responsible position in relation to the operation of the relevant device or the relevant activity.
The Supreme Court has, however, made it clear that the requirements under Section 84(2) may be established by oral evidence or by the certificate contemplated under Section 84(4).

SO, DON'T JUST SCREENSHOT!
If you think a WhatsApp conversation may become important in a legal dispute: Preserve the original conversation, Keep the phone/device where possible, Don't edit or manipulate the messages, Preserve the surrounding conversation and relevant attachments, Keep other evidence that can help establish who sent or received the messages.
A screenshot may be useful, but the court is concerned with whether the electronic evidence satisfies the law and can be properly authenticated and relied upon.

⚖️ CAN WHATSAPP CHATS BE USED AS EVIDENCE IN COURT?
“It was only a WhatsApp conversation.”
That is something people often say when a dispute arises. But what if that WhatsApp conversation contains the exact words, agreement, admission or information that proves your case?
Can you take that chat to court and rely on it as evidence? Yes, potentially.

Under the Evidence Act 2011, electronic records can be admissible in court where the requirements for admissibility are satisfied. This may include WhatsApp chats, text messages, emails, photographs, videos and other electronic records.

A WhatsApp conversation may become relevant evidence in matters involving:
1. Contracts and agreements
2. Business transactions
3. Employment disputes
4. Property matters
5. Admissions
6. Threats or harassment
7. Promises or undertakings
8. Family and personal disputes

But there is an important point: A screenshot does not automatically prove that everything shown on it is genuine. The authenticity and reliability of the electronic evidence may be challenged, and the requirements of the Evidence Act must be satisfied.
So, if a WhatsApp conversation may become important in a legal dispute: DON'T DELETE IT. Keep the original conversation and preserve the device and other relevant evidence where possible.
WhatsApp may be casual, but what you write there can have serious legal consequences. Think carefully before you type.

⚖️ WHAT TO DO IF YOUR LANDLORD REFUSES TO RETURN YOUR CAUTION FEE
You move out of a rented apartment, hand over the keys, and expect your caution fee to be returned. Instead, the landlord says:
“I am not giving you the money back.”
What can you do?
1. CHECK YOUR TENANCY AGREEMENT.
Look at what the agreement says about the caution fee, when it should be returned and the circumstances in which the landlord may deduct from it.
2. ASK FOR A BREAKDOWN OF ANY DEDUCTIONS.
If the landlord says the money was used to cover repairs or other expenses, ask for a clear explanation of what was deducted and why.
3. KEEP YOUR EVIDENCE.
Keep the tenancy agreement, receipts, proof of payment, photographs of the property before and after your tenancy, messages and evidence showing that you handed over the property.
4. MAKE A FORMAL REQUEST FOR YOUR REFUND.
Write to the landlord requesting the return of the caution fee and give a reasonable period for the landlord to respond.
5. SEND A FORMAL DEMAND LETTER.
If the landlord still refuses to return the caution fee, consider sending a formal demand letter through your lawyer, requesting the refund and giving the landlord 7 days to pay. The letter should state that failure to comply may result in further legal action to recover the money, where appropriate.
Keep a copy of the letter and proof that it was delivered.
The important thing to remember is:
A landlord should not simply keep a tenant's money without a lawful or contractual basis.
However, if the tenancy agreement permits deductions for actual damage, unpaid bills or other specified obligations, the landlord may be entitled to make appropriate deductions.
So before accepting that your caution fee is “gone,” check the agreement and ask the landlord to explain the deduction.

⚖️ WHAT TO DO IF YOU BUY FAULTY GOODS AND THE SELLER REFUSES TO REFUND YOU
You buy a product, get home, and discover that it is faulty. You return to the seller, but the seller says:
“No refund.” That’s ILLEGAL.
What can you do?
1. Keep your proof of purchase.
Keep your receipt, invoice, payment evidence, messages with the seller, photographs and videos showing the defect.
2. Inform the seller immediately.
Explain the problem clearly and ask for an appropriate remedy, such as repair, replacement or refund, depending on the circumstances.
3. Do not simply accept a “NO REFUND” policy.
A seller cannot use a blanket policy to take away rights that the law gives a consumer. The FCCPC has recently highlighted the importance of consumer protection and has intervened in cases involving defective or unsatisfactory products. (FCCPC)
4. Make a formal complaint.
If the seller refuses to resolve the matter, you can make a complaint to the Federal Competition and Consumer Protection Commission (FCCPC). The Commission's mandate includes protecting consumers and ensuring that goods and services meet appropriate standards. (FCCPC)
5. You may have a legal claim.
If the seller refuses to resolve the matter, you may have a legal right to seek a remedy under the Federal Competition and Consumer Protection Act, 2018. Depending on the circumstances, this may include returning the faulty goods and seeking a repair, replacement or refund as provided by law.
So, if you buy a faulty product, don't just throw it away and walk away from the matter.
Keep your evidence, complain to the seller, and if the matter is not resolved, consider the appropriate legal or regulatory remedy.
⚖️ KNOW YOUR RIGHTS. KNOW THE LAW.
