This article summarises the following 6 things about setting aside arbitral awards:

1. It is governed by Section 37 of the Arbitration Act 2005;

2. As a general rule, applications have to be filed within 90 days;

3. Applications are by way of Originating Summons supported by affidavit;

4. Courts should be slow to set aside an arbitral award:

5. Applications can be adjourned where appropriate; and

6. Money payable under the Award can be secured pending the determination of the application.

Our firm had the privilege of being the solicitors for the Malaysian Bar in its role as amicus curiae (friend of the Court) in the civil suit brought by Pastor Raymond Koh & his wife in relation to Pastor Raymond Koh's enforced disappearance.

Our firm's partner, Joshua Wu, together with Mr. Andrew Khoo Chin Hock (of Messrs. Andrew Khoo & Daniel Lo) were the counsels for the Malaysian Bar.

On 5th November 2025, the High Court found in favour of the Plaintiffs. [1]

The Attorney General's Chambers, representing the Defendants, filed an appeal to the Court of Appeal on 6th November 2025.

In this article, we look at discovery applications against parties to a suit:

1. Governed by Order 24 Rule 7 of the Rules of Court 2012;

2. Has to satisfy the trite test - namely possession, relevance, necessity;

3. The threshold is high but lower than that of pre-action discovery:

In this article, we look at applications for discovery against non-parties.

In summary:

1. Such applications are governed by Order 24 Rule 7A of the Rules of Court 2012.

2. Discovery will be ordered only if the Court is satisfied it is necessary.

3. The whole intent is saving of costs, resources, and time.

4. The documents sought must be specified or sufficiently described.

5. Three counter-constraints must be considered - namely the problem of fishing, confidentiality & privacy, and the increase in costs.
