Today I want to share five key tips if you’re thinking about buying a home in Mexico as a foreigner.

Number one: Make sure the property has clean legal documentation.
Before you commit, check that the property is properly registered with the Public Registry and that there are no liens, lawsuits, or outstanding debts for property tax, water, or maintenance. This should be reviewed by a trusted attorney or notary.

Number two: If the property is in a restricted zone, purchase through a bank trust.
As a foreigner, if you’re buying near the coast or border, you’ll need to use a fideicomiso — a legal bank trust. It’s a secure and legal way to own property in Mexico with full rights to use, rent, or sell.

Hoy quiero compartirte 5 recomendaciones clave si estás pensando en comprar una casa en México siendo extranjero.



🏡 1. Asegúrate de que el inmueble tenga la documentación en regla
Antes de comprometerte, verifica que la propiedad esté inscrita en el Registro Público de la Propiedad y que no tenga gravámenes, juicios o adeudos de predial, agua o mantenimiento. Esto debe revisarlo un abogado o notario de confianza.



📍 2. Si está en zona restringida, compra mediante fideicomiso

✳️ Introduction

Mexico offers excellent real estate opportunities for foreigners, especially in beach destinations like Puerto Vallarta. However, to invest safely and legally, it’s important to understand the legal process, requirements, and best practices.



1️⃣ CAN FOREIGNERS BUY PROPERTY IN MEXICO?

Yes, but with a key restriction:
If the property is within:
• 50 km (31 miles) from the coast, or
• 100 km (62 miles) from the border,

…foreigners cannot own land directly. Instead, they must purchase via a bank trust (fideicomiso) or a Mexican corporation.

Puerto Vallarta is within the restricted zone, so a fideicomiso is the standard solution.



2️⃣ WHAT IS A FIDEICOMISO (BANK TRUST)?

A fideicomiso is a legal trust agreement between:
• A Mexican bank (the trustee),
• The foreign buyer (you), and
• The seller of the property.

✔️ The bank holds the title on your behalf.
✔️ You have full rights to use, rent, remodel, or sell the property.
✔️ The trust lasts 50 years, renewable.
✔️ There is an annual maintenance fee (typically $500–$800 USD).



3️⃣ STEP-BY-STEP: HOW TO BUY SAFELY

✅ Step 1: Hire a trusted real estate agent
• Look for someone with experience serving foreigners.
• Preferably bilingual and certified.

✅ Step 2: Conduct a full legal check
• Verify clear title and no legal issues.
• Ensure taxes and utilities are up to date.
• Confirm property registration.

✅ Step 3: Make an offer and sign a purchase agreement
• Include deposit terms, deadlines, and contingencies.
• Have the contract reviewed by a qualified attorney.

✅ Step 4: Open your fideicomiso (or Mexican company)

Are you looking for a house in Mexico? What do you need to check?

1)Remember that if you want a property less than 50 kilometers from the sea you need a trust.

2)Consult the property documentation before making the purchase.
The deed must be in the name and 100 percent of the person selling the property; If there is more than one owner, they must all sign. 😎 Visit the Public Registry and request a specific certificate of free encumbrance for this property. This confirms who the owner is and whether or not the property has a lien or mortgage.

3) Select the bank 🏦 that will be the trustee, remember when you start the contract they all work well, but when you try to give some instructions for some changes it is a headache 🤕 because they do not give a quick solution. In Pv there are some specific offices for the fiduciary of different banks, get to know each one and choose the one you feel most comfortable with. In my experience Banco del Bajío is a good option, they are in the Peninsula.

4) Choose a notary, my recommendation is to make an appointment with three different options and obtain the expenses, ask everything you want to know, remember to write down your questions before the appointment.
