Suspension of electronic visa service by Moldova
By point 9 of Provision no. 57 of 19.01.2023 of the Commission for Exceptional Situations of the Republic of Moldova, the procedure for granting B and C visas through the electronic system https://www.evisa.gov.md/ was suspended. The visas can be obtained by the applicants by submitting the requests and held the interview in person at the diplomatic and consular missions of the Republic of Moldova. The provision does not contain any argumentation of the need to impose such a restriction.
We assume that the intention of adopting such a measure resides in the need to prevent illegal migration (which has recently been observed at the borders of the Republic of Moldova), but it is wrong to cancel a facilitated mechanism for granting visas (which corresponds to the global trends of digitalization) in the situation in which additional requirements/checks/conditionalities might be imposed in the visa process.
We believe that the decision of the authorities is an unadvised one that will affect both the business climate and the tourism sector in the Republic of Moldova.
The situation becomes downright contradictory when a businessman from the East is in possession of a Schengen visa or a visa issued by Great Britain and is going to held an interview at an embassy that may be thousands of kilometers from his place of residence because the Republic of Moldova has few open diplomatic missions in Asia and practically none - in Latin America and Africa.

Istoria unui audit juridic
Despre beneficiile auditului juridic se poate de vorbit îndelung și plictisitor sau se poate relata experiența echipei Cenușă & Onofrei Consulting care a prestat acest serviciu unuia din beneficiari.
Deci, clientul avînd calitatea de debitor într-o cauză civilă intentată de un parter de afaceri al acestuia și fiindu-i revendicate datorii de ordinul zecilor de mii de euro a solicitat asistență echipei noastre.
Noi am analizat pretențiile creditorului și am constatat că între părți existau relații comerciale complexe de lungă durată (unul a fost furnizor pentru celălalt, aveau încheiate și contracte de prestări servicii etc.). Respectiv, i-am propus clientului să efectuăm un audit juridic al tuturor contractelor existe între părți ca în cele din urmă să constatăm că existau creanțe pe care clientul nu le-a revendicat de la acest creditor, motivele fiind banale – se schimbase juristul, contabilul, aceste sume nu au fost reflectate corect în evidența contabilă urmare a calificării și interpretării eronate a prevederilor acelor contracte comerciale.
Drept urmare a fost înaintată o cerere reconvențională, iar clientul nostru a obținut cîștig de cauza (Decizia fiind definitivă și irevocabilă). Pretinsul creditor fiind obligat să restituie clientului nostru o sumă dublă față de creanța solicitată inițial de el.
Inspirat de succesul cauzei, clientul a solicitat un audit juridic complex al activității societății, care a dezvăluit probleme comune pentru majoritatea societăților comerciale – existența unor contracte standardizate ce comportă riscuri juridice și generează litigii, ineficiența gestionării proceselor judiciare ș.a.
Rezultă deci, că auditul juridic are aceeași pondere în gestionarea eficientă a societății ca și auditul contabil/financiar și urmează a fi implementat în societățile comerciale cu o frecvența de la 1-2 ani.

For the second consecutive year, the volume of exports made by companies in the IT industry in the Republic of Moldova exceeded the traditional fields of export (wines, textiles, etc.).
According to the National Bank of Moldova, in 2020 the value of exports of IT services and products reached USD 258.5 million, increasing by 23.2% compared to 2019 and more than 3 times higher compared to the 2016 indicator.
Moldova IT Park residents delivered on the international markets IT services and products worth USD 226.5 million in 2020, that is 88% of the total volume of exports made by the IT industry in our country.

Granting the permit of stay for foreign investors in the economy of the Republic of Moldova

Starting a business and making investment in a local company in Moldova provides an opportunity for the foreign investor to get a residence permit and legal stay in Moldova for a longer period in a more expedited manner.
Foreign investors may be qualified to receive the permit of stay based on foreign investments made in the local company.
The permit of stay under this regime may be also granted to the individual (foreign citizen) acting as the shareholder and the administrator of local companies. The investment made in a company includes the contribution to share capital and the loans granted by the shareholder.
