We want to share a recently won case, which may be relevant to our Clients and Followers.

We got a call from a person explaining that he, despite having a valid TRP (issued by another EU country), was stopped at the border and was refused of entry to the Republic of Lithuania and he does not understand the grounds of this event. During the transit across the border, the state border guards handed him a decision refusing an entry at the border. In the decision was indicated that his data corresponds with the warning registered in the national registration system, with the additional notes in the decision stating "threat to national security". Clientโ€™s passport was also stamped with the letter H, which, according to the Schengen Borders Code, stands for "is a person for whom an alert has been issued for the purposes of refusing entry in the SIS or in the national register".

The person did not know and could not explain nor the reasons for which the decision to refuse an entry to the Republic of Lithuania was made, nor why the decision stated about him posing a threat to national security, since he did not have any other decision made in relation to him, which would indicate those circumstances or grounds. Also, considering that our client already had a stamp with the letter H in his passport, it was not possible for him to come to Lithuania to his family members/relatives, and the client was also worried about what exactly was indicated in the registry system about him, and whether there would be any obstacles to continue to move freely within the EU/Schengen borders.

After consultation with the client, it was decided to appeal the decision, asking the Court to annul it, and to ask the court to obligate state border guards to submit the material on the basis of which the decision was made (it was not disclosed to the client).

After the case went to court, the State Border Guard Service submitted a response to our appeal, asking the appeal to be rejected. After getting acquainted with the response material submitted by the State Border Guard Service, the lawyers noticed that the data of the person who is prohibited from entering and settling in the Schengen area only partially matched with the represented client, i.e. the first and last name and a birth date matched, but the person for whom the ban was entered in the system has a different middle name and a different place of birth than out client. Consequently, the officials unreasonably made the decision, at the same time unreasonably entered the letter H in the passport and entered the client's data into the system, limiting his right to move in the EU.

After the lawyers explained to the court all of the differences between the person whose data is in the system and the represented client, the officers admitted that they made a mistake, - the Court annulled the decision of the refusal of entry (the stamp in the client's passport was accordingly canceled).

Most of you have already heard about the 2023-06-07 decision of the Constitutional Court of the Republic of Lithuania, adopted in case no. 10-A/2022 , but as we can see, most of you have questions about the essence/main aspects of the decision itself.

So, what are the essential aspects of this ruling?

According to the legal regulation applicable at that time, all foreigners who submitted requests for asylum were accommodated in specified places for up to 6 months, without giving them the right to move freely in the territory of the Republic of Lithuania, without any decision of the relevant competent authority, based solely on the fact that the asylum seekers are in the Republic of Lithuania and their asylum applications have not yet been substantively examined.

In this case was raised a question about the regulationโ€™s by which, due to the massive influx of foreigners in the event of a declared state of emergency, state of emergency or war, all asylum seekers were temporarily accommodated in specified places until a decision was made on their legal status, without giving them the right to move freely in the territory of the Republic of Lithuania, when such accommodation could last up to 6 months (hereinafter - Measure), compliance with the Constitution of the Republic of Lithuania.

First, the Court explained that, the accommodation of asylum seekers in camps, establishing the right to move only in the territory belonging to the place of accommodation, could be equated to one of the strictest measures of restriction of personal freedom, which, due to the intensity and duration of the limitation of personal freedom, could be equated to the detention of a person.

Secondly, the Court found that when applying the mentioned Measure, there were no opportunities to individually assess the situation of each person. In the absence of any decision of the relevant competent authority, during the restriction of freedom of movement, foreigners were not guaranteed the right of asylum seekers to check the validity and legality of the Measure applied to them in court, when this right is ensured in to persons who are detained (or an alternative measure to detention is applied).

Thirdly, in the Court's opinion, the mere fact that a state of emergency or state of emergency has been declared due to a massive influx of foreigners cannot in itself be a basis for applying the Measure to all asylum seekers, without assessing each of their individual situations and specific circumstances.

In summary, a person's freedom cannot be restricted more than is necessary to achieve a legitimate goal, and when deciding on the validity of restricting a person's freedom, it is necessary to assess the individual situation of each person as much as possible and to individualize the specific measures limiting their freedom to be applied to that person and to ensure the right to appeal to the court in order to assure the validity and legality of the Measure.

The Constitutional Court of the Republic of Lithuania recognized that the application of the specified regulation/Measure, to the extent that according to it, all asylum seekers must be accommodated in specified places, without giving them the right to move freely in the territory of the Republic of Lithuania, without the competent institution making a decision that can be appealed to the court, contradicts Article 20 of the Constitution of the Republic of Lithuania.

If you do not have the opportunity to apply to your country of origin for the issuance of a new passport, and you have a temporary or permanent residence permit in the Republic of Lithuania, you can apply to the Migration Department for the issuance of a foreigner's passport. The application is submitted on the MIGRIS platform, together with an explanation of why you cannot get a passport from your country of origin.

A foreigner's passport is valid no longer than the validity of your temporary or permanent residence permit in the Republic of Lithuania, but no less than 3 months and no longer than 5 years.

A) An asylum seeker, while waiting for a decision in the asylum procedure, acquires the right to work in Lithuania after 6 months from the moment of submission of the request for the asylum. The 6-month period is calculated from the submission of the application for asylum, not from the day of the arrival to the Republic of Lithuania. It is also important to note that asylum seekers are exempted from the obligation to gain a work permit issued by the Employment Service (until decisions on their asylum are made).

B) In the meantime, if the Migration Department has already made a decision not to grant an asylum, until the person is deported to the country of origin, he also has the right to work while staying in the Republic of Lithuania. The right to work or engage in self-employment is acquired 12 months after the person submitted an asylum application to the Migration Department. In this case, in contrast to asylum seekers, a person whose asylum application procedure has been completed must simultaneously obtain a work permit issued by the Employment Service. The work permit must be obtained before singing the contract of employment.

It is the duty of that authority, on the contrary, to examine that application and to assess whether there exists, between the third-country national and Union citizen concerned, a relationship of dependency of such a nature that a derived right of residence must, as a general rule, be accorded to that third-country national, under Article 20 TFEU, since otherwise the Union citizen would be compelled, in practice, to leave the territory of the European Union as a whole and, therefore, would be deprived of the genuine enjoyment of the substance of the rights conferred on him by that status. In such circumstances, the Member State concerned must withdraw or, at the least, suspend the return decision and the entry ban to which that third-country national is subject;
2) it does not matter that the dependency relationship relied on by the third-country national in support of the application for a residence permit for the purpose of family reunification arose after a decision was made to prohibit entry into the country;
3) it does not matter that the decision to ban a third-country citizen from entering the country is final at the moment when he submits an application for a residence permit in the country for the purpose of family reunification.

Usually, a request is submitted for the shortening of the ban on entry or, in exceptional circumstances, its cancellation, and a request for permission to submit documents for the issuance of a temporary residence permit on the basis of family reunification. Unfortunately, sometimes Migration Department refuses to consider such requests stating that the person in Lithuania is illegally, and the institution that made the decision on a ban of entry - refuses to cancel/shorten the entry ban - so the specified decisions have to be appealed to the court.

As for today, we can be proud of the victories of our team of lawyers in such cases, for example:
1) The client was refused permission to submit documents for the issuance of a temporary residence permit in Lithuania on the basis of family reunification, after the Migration Department indicated that the person is in Lithuania illegally. At the time of submitting the application, the client had a spouse and a minor child in the Republic of Lithuania.
After representing the client in court, the court stated that the Migration Department illegally and unreasonably refused to consider the person's request for permission to submit documents, based solely on his illegal presence, and ordered to re-examine his request (case no. eA-4105-438/2021);

2) The client applied for a request to cancel the ban on entry to Lithuania, arguing that he has a spouse in Lithuania, plans to have children, and that the spouse cannot go with him to his country of origin for the period of the ban on entry - in this way, their family would be separated. The Migration Department shortened the period of the entry ban, but did not lift it.
While representing the client in court, the court indicated that the client's family ties with persons in the Republic of Lithuania were recognized as a proportionally more significant circumstance than the circumstances forming the basis for deporting the applicant to the country of origin according to the procedures and establishing a ban of entry for him to come to the Republic of Lithuania. Also, Migration Department did not assess the family's interests in its decision (case no. eA-3314-502/2021);

3) The client submitted a request to cancel the ban on entry to Lithuania, arguing that he will be separated from his newborn child for the period of the ban, and his spouse cannot provide childcare alone. The Migration Department shortened the period of the entry ban, but did not lift it.
While representing the client's interests in court, the panel of judges stated that the Migration Department did not assess the family's interests and did not sufficiently justify the need of the ban on the client's arrival, which resulted in departmentโ€™s decision annulment (case no. eA-4174-463/2022).
