SKI organized a technical workshop today, bringing together representatives from the Ministry of Justice – Commercial Register (Supervising Judge at the Commercial Register), Ministry of Finance – Tax Administration Department, and the Public Procurement Authority, to review the proposed Unified Beneficial Ownership Information Declaration Template , developed under the study “Utilizing Beneficial Ownership Information in Public Procurement”.

The session focused on revising and refining the template based on institutional inputs, with the objective of enhancing data harmonization, strengthening inter-institutional coordination, and promoting greater transparency across relevant registries and oversight bodies.

This workshop was conducted within the framework of the “Transparency and Reform for the Prevention of Corruption (TRACE)” project, under the broader “Support to Inclusive Governance and Reform Processes in Lebanon (IGOR)” programme, implemented by GIZ Lebanon in partnership with SKI for Research & Consulting and GITEC-IGIP GmbH.

بعد مرور عشر سنوات على إقرار قانون مكافحة تبييض الأموال وتمويل الإرهاب رقم ٤٤/٢٠١٥، أظهر كتاب العدل والمحامون وخبراء المحاسبة المجازين مستويات منخفضة للغاية من الامتثال لالتزاماتهم المتعلقة بمكافحة تبييض الأموال وتمويل الإرهاب وفقًا للمادة ٥ من القانون كما يظهر الجدول في الصورة. على مدار السنوات العشر الماضية، برروا عدم امتثالهم متذرعين بالسرية المهنية.

اليوم، بعد إدراج لبنان على اللائحة الرمادية، طلبت مجموعة العمل المالي (فاتف) تعديل المادة ٥ كجزء من الإجراءات التصحيحية المطلوبة من لبنان للخروج من اللائحة، من خلال النص صراحةً على أنَّهُ لا يُمكن التذرع بالسرية المهنية في وجه الهيئات الرقابيَّة ولا تشمل هذه السريَّة المعاملات التي تيسِّر وتسهِّل تبييض الأموال وتمويل الإرهاب.
أقرَّت الحكومة اللبنانية تعديلاً للمادَّة ٥ وأرسلته إلى مجلس النواب. يقع على عاتق مجلس النواب الآن واجب إقرار نص لا يحمل التأويل ويجبر كتَّاب العدل والمحامون وخبراء المحاسبة المجازين على الالتزام بموجبات مكافحة تبييض الأموال وتمويل الإرهاب دون القدرة على التحايل على أحكام القانون.

إنَّ هذا الإجراء هو خطوة ضروريَّة أساسيَّة وشرط مسبق للشروع بمعالجة الاقتصاد النقدي الذي له أثر مدمر على الاقتصاد اللبناني والحياة اليوميَّة للبنانيين على المدى الطويل.

Almost 10 years after the adoption of the new Anti-money Laundering and Terrorism Financing Law No. 44/2015, public notaries, lawyers and certified public accountants showed very low levels of compliance with their AML/CFT obligations in accordance with Article 5 of the law as shown in the graph. Over the past ten years they justified their non-compliance by citing professional secrecy.

Today, the Financial Action Task Force after grey-listing Lebanon, has requested the amendment of Article 5 as part of the corrective measures required from Lebanon to exit the grey-list, by explicitly stating that professional secrecy does not stand before oversight bodies and should not cover transactions that enable money laundering and terrorism financing.

The Lebanese government has sent an amendment to the parliament. The parliament now has the duty to make sure that unfounded justifications by notaries, lawyers and CPAs do not stand and compel them to adhere to their AML/CFT obligations.

This measure is a necessary fundamental step and a prerequisite for initiating the fight against the cash economy, which has a devastating impact on the Lebanese economy and the daily lives of the Lebanese people on the long term.
