On our page, we make Korean law accessible and easy to understand. In our series on Korean inheritance and estate law, we'll be breaking down what you need to know.

Today, we're explaining Korea's legal reserve of inheritance, a.k.a. 유류분 (Yuryubun). This is Korea's legal minimum inheritance share — a protection that prevents heirs from being completely cut out by a will or by pre-death gifts.

Spouses and children are guaranteed at least ½ of their standard legal share, regardless of what a will says. Even if your parent gave everything to someone else before they died, you may still have a claim.

⚠️ Time limits apply. The deadline to file can be as short as 1 year from when you became aware.

Korea's National Assembly Defense Committee passed an amendment on April 14, 2026 that raises the military service age limits by five years.

Previously, Korean men who stayed overseas without returning were exempt from enlistment obligations at age 38, with all service obligations ending at 40. Under the new amendment, those thresholds rise to 43 and 45 respectively.

Over 5,000 Korean men per year were aging out of service obligations by staying overseas. The amendment is designed to close that loophole and raise awareness about draft evasion.
