There's been a lot of buzz about Justice Nyakundi's recent decision regarding civil jail for judgement debtors, but it's important to clarify that this finding is not new - it is simply a restatement of the law.

The court did not outlaw civil jail. What Justice Nyakundi affirmed is that civil jail is reserved for judgement debtors who have the means to pay but willfully and deliberately refuse to do so. Those without the means cannot be committed to civil jail, as doing so would defeat the very logic and purpose of the law.

This is settled law. Justice Koome (as she then was) articulated the same principle back in 2012 in the case of Re Zipporah.
