🇮🇹 Understanding the Catasto: Italy’s Property Register Explained 🏠

In Italy, all properties are recorded in the Catasto (Cadastre). It is a national register managed by the Agenzia delle Entrate (Tax Authority) that contains the technical and fiscal details of all buildings and land.

✅ It’s essential to check the Catasto before buying, to verify that the property is correctly registered and matches its real condition.

📋 What does the Catasto provide?
• Type of property (land or building)
• Location and size
• Official tax value

🏡 The Catasto is divided into two parts:
• Land Cadastre (Catasto Terreni) – for land
• Urban Cadastre (Catasto Edilizio Urbano) – for houses, apartments, and buildings

🔍 How to request a visura catastale (cadastral search):
You can use:
➡ the property’s identification
➡ the owner’s name
➡ or their tax code

This can be done:

🏢 at the offices of the Agenzia delle Entrate,

👉 Important:
The Catasto provides technical and fiscal information, but does not give legal proof of ownership. That is handled by the Conservatoria dei Registri Immobiliari.

🇮🇹 “My father left everything to his second wife. But we are three children… and Italian law said we had rights.”

When an Italian citizen dies, they can’t freely dispose of all their assets.

Even with a valid will, the law reserves part of the estate for certain close relatives:
✅ The surviving spouse
✅ Children (even from previous marriages)
✅ parents

This is called “la quota legittima”—the forced heirship quota.

📌 In the case of a spouse and multiple children:
➡️ Half of the estate must go to the children
➡️ One quarter must go to the spouse
➡️ Only the remaining quarter can be freely disposed of by will

So when Marco’s father passed away and left everything to his new wife, the three adult children thought it was final.

📌 Let’s talk about cross-border successions: what if assets are in more than one country?

🔎 What does Regulation (EU) No 650/2012 say?

As a general rule, the law applicable to the entire succession is that of the country where the deceased had their habitual residence at the time of death.

However, a person may choose in advance the law of their nationality to govern their succession.

This choice must be clearly expressed in a will or similar legal document.

⚠️ Important limits:
The Regulation does not cover:

Inheritance taxes

Matrimonial property regimes or issues of joint ownership

🧾 Examples:

James, a US citizen living in Italy, owns property in both Italy and the US.
👉 If he dies in Italy without a Will, Italian law applies by default, even on properties in the USA.
