What if police refuses to file an FIR! Generally in cognizable offences as per the guidelines of supreme court police is bound to register an FIR!

Remedies if police refuses to register an FIR
1. Send a letter to superintendent of police !

2. After exhausting the first remedy still no FIR has been filed then the aggrieved party can file a private complaint under section 156 before the magistrate and seek directions for registration of FIR!

The above mentioned remedies are relating to cognizable offences!

What remedy do u have if a judge passes an ex- parte order!There are times when the lawyer is not able to appear before the court due to being over occupied in other matters

The person has following remedies
1. Move an application for dismissal of exparte order before the same judge

2. File an appeal against the exparte order! ( if appeal is filed and disposed off than application for dismissal cant be moved)

3. File a review!

4. If the appelate court ( court in which appeal is filed) doesnt reverse the exparte order and disposes of the appeal then second appeal can be filed!
