Several universities and law colleges questioned whether the Bar Council of India had authority to regulate legal education, since universities are normally governed by the University Grants Commission (UGC).

Whether BCI can prescribe standards and rules for legal education in India.

Receipt under the Indian Stamp Act, 1899

Definition:
Receipt means a written acknowledgment of receiving money, goods, or property (Section 2(23)).

Stamp Requirement:

Amount below ₹5,000 → No stamp required
Amount ₹5,000 or more → ₹1 revenue stamp required

Important Rule:
The person issuing the receipt must sign across the revenue stamp.

Purpose of the Provision:

Prevents fraud and false claims.
Maintains proper record of payment.
Makes the receipt legally valid evidence.

Effect of No Stamp:
The receipt may not be accepted as evidence in court unless stamp duty and penalty are paid.

Example:

हनुमानपरसौद पांडे विरुद्ध बाबूई मुनराज कुनवेरी (१८५६):

प्रिव्ही कौन्सिलने असा निर्णय दिला की व्यवस्थापक (कर्ता) केवळ कायदेशीर गरजेसाठी किंवा इस्टेटच्या फायद्यासाठी संयुक्त कुटुंबाची मालमत्ता हस्तांतरित करू शकतो. अशा गरजेबद्दल सद्भावना आणि वाजवी चौकशी दाखविण्याची पुराव्याची जबाबदारी कर्ज देणाऱ्यावर (परदेशी) असते. योग्य तपासणी केली गेली तर, नंतर आवश्यकता अस्तित्वात नसल्याची पुष्टी झाली तरीही, प्रामाणिक कर्जदाराला संरक्षण दिले जाते. हिंदू कायद्यानुसार कर्ताच्या हस्तांतरित होण्याच्या वैधतेवर हा खटला प्रमुख अधिकार आहे.

Hanoomanpersaud Panday v. Babooee Munraj Koonweree (1856):

The Privy Council held that a manager (Karta) can alienate joint family property only for legal necessity or benefit of the estate. The burden of proof lies on the lender (alienee) to show good faith and reasonable inquiry about such necessity. A bona fide creditor is protected even if the necessity later proves nonexistent, provided proper due diligence was made. This case is the leading authority on the validity of a Karta’s alienation under Hindu Law.

प्रिवी काउंसिल ने माना कि एक मैनेजर (कर्ता) जॉइंट फ़ैमिली प्रॉपर्टी को सिर्फ़ कानूनी ज़रूरत या एस्टेट के फ़ायदे के लिए ही अलग कर सकता है। ऐसी ज़रूरत के बारे में अच्छी नीयत और सही जांच दिखाने का सबूत देने की ज़िम्मेदारी लेंडर (अलग किया गया व्यक्ति) पर होती है। एक असली क्रेडिटर तब भी सुरक्षित रहता है, भले ही बाद में यह साबित हो जाए कि ज़रूरत नहीं है, बशर्ते सही जांच की गई हो। यह केस हिंदू लॉ के तहत कर्ता के अलग किए जाने की वैलिडिटी पर सबसे अहम अथॉरिटी है।

SUIT AND ITS KINDS

I. Introduction

A suit is the basic method of enforcing civil rights in a court of law.

The Code of Civil Procedure, 1908 (CPC) regulates institution, trial, and decree of suits.

CPC does not define the term “suit”; meaning developed through judicial decisions.

A suit is different from appeals, revisions, petitions, or applications.

It is initiated in a civil court for enforcement of private rights.

II. Definition of Suit

A suit means:

A civil proceeding instituted by presentation of a plaint in a civil court, seeking enforcement of a civil right against a defendant.

Key Features:

Initiated by plaint

Filed in a competent civil court

III. Judicial Interpretation

लीज़ बनाम लाइसेंस –

सुप्रीम कोर्ट ने बार-बार लीज़ और लाइसेंस के बीच का अंतर साफ़ किया है। आइए इसे आम भाषा में समझते हैं।

1️⃣ लीज़ क्या है?

ट्रांसफर ऑफ़ प्रॉपर्टी एक्ट के सेक्शन 105 के तहत:

लीज़ का मतलब है कि आप किराए के बदले में किसी को एक तय समय के लिए प्रॉपर्टी इस्तेमाल करने का अधिकार देते हैं।

आसान शब्दों में:

अगर आप अपना घर किसी को 11 महीने के लिए किराए पर देते हैं, और उस व्यक्ति को पूरा कब्ज़ा और कंट्रोल मिल जाता है, तो वह लीज़ है।

खास बातें:

किराएदार को खास कब्ज़ा मिलता है। मालिक भी आज़ादी से अंदर नहीं जा सकता।
इससे प्रॉपर्टी में कानूनी दिलचस्पी बनती है।
मालिक कुछ समय के लिए प्रॉपर्टी इस्तेमाल करने का अपना अधिकार छोड़ देता है।
आमतौर पर एक तय समय और तय किराए के लिए।

खास बातें:

कोई खास कब्ज़ा नहीं।
मालिकाना हक का कोई ट्रांसफर नहीं।
यह सिर्फ़ एक इजाज़त है, प्रॉपर्टी का अधिकार नहीं।
इसे आमतौर पर ज़्यादा आसानी से रद्द किया जा सकता है।

असल ज़िंदगी का उदाहरण:

आप अपने होटल की लॉबी के अंदर एक फ़ूड स्टॉल चलाने की इजाज़त देते हैं। स्टॉल मालिक उस जगह का इस्तेमाल कर सकता है, लेकिन आप उसे रेगुलेट, सुपरवाइज़ कर सकते हैं, या हटा भी सकते हैं। यह लाइसेंस है।

3️⃣ सुप्रीम कोर्ट ने क्या कहा?

एसोसिएटेड होटल्स केस में, सुप्रीम कोर्ट ने कहा:

असली टेस्ट यह नहीं है कि डॉक्यूमेंट का नाम क्या है।
असली टेस्ट पार्टियों का इरादा और एक्सक्लूसिव पज़ेशन है।

अगर व्यक्ति के पास एक्सक्लूसिव पज़ेशन है और मालिक दखल नहीं दे सकता, तो यह शायद लीज़ है।
अगर यह सिर्फ़ इस्तेमाल करने की परमिशन है, तो यह लाइसेंस है।

हाल ही के विवेकानंद केंद्र केस में, कोर्ट ने फिर से जांच की कि क्या अरेंजमेंट एक्सक्लूसिव पज़ेशन देता था या सिर्फ़ परमिशन थी। कोर्ट इन चीज़ों को देखता है:

Lease vs Licence –

The Supreme Court has repeatedly clarified the difference between a lease and a licence. Let us understand this in practical, everyday language.

1️⃣ What is a Lease?

Under Section 105 of the Transfer of Property Act:

A lease means you transfer the right to enjoy a property to someone for a fixed time in return for rent.

In simple terms:

If you give your house to someone on rent for 11 months, and that person gets full possession and control, that is a lease.

Key features:

The tenant gets exclusive possession. Even the owner cannot enter freely.
It creates a legal interest in the property.
The owner temporarily gives up his right to use the property.
Usually for a fixed period and fixed rent.

Real life example:

You rent out your flat in Pune for 2 years. The tenant locks it, lives there, and you cannot enter without permission. That is a lease.

2️⃣ What is a Licence?

Under Section 52 of the Indian Easements Act:

A licence means giving someone permission to use property without transferring any ownership or interest.

In simple terms:

It is like allowing someone to use your property, but you still remain in control.

Key features:

No exclusive possession.
No transfer of ownership interest.
It is only a permission, not a property right.
Can usually be revoked more easily.

Real life example:

You allow a food stall to operate inside your hotel lobby. The stall owner can use the space, but you can regulate, supervise, or even remove him. That is a licence.

3️⃣ What Did the Supreme Court Say?

In Associated Hotels case, the Supreme Court said:

The real test is not what the document is called.
The real test is intention of the parties and exclusive possession.

If the person has exclusive possession and the owner cannot interfere, it is likely a lease.
If it is only permission to use, it is a licence.

In the recent Vivekananda Kendra case, the Court again examined whether the arrangement gave exclusive possession or was merely permission. The Court looks at:

Actual control
Terms of agreement
Practical working of the arrangement
Not just the label.

4. One Line Understanding

A lease gives you a right in the property.
A licence only gives you permission to use it.

1 अप्रैल 2026 से, इनकम टैक्स एक्ट, 2025 (FY 2026-27 के लिए लागू) के तहत, डिजिटल ट्रांज़ैक्शन को बढ़ावा देने के लिए कैश निकालने पर TDS को रेगुलेट किया जाएगा, जिसमें सेक्शन 393 (या पुराने 194N की जगह इसी तरह के नियम) के तहत नियम होंगे।
आम तौर पर, सालाना 1 करोड़ रुपये से ज़्यादा के कुल कैश निकालने पर 2% TDS लगता है, और अगर पिछले तीन सालों से ITR फाइल नहीं किए गए हैं तो 5% TDS लगता है (20 लाख रुपये की कम लिमिट लागू हो सकती है)।

कैश निकालने पर TDS:

कैश निकालने पर TDS इनकम टैक्स एक्ट के सेक्शन 194N के तहत आता है। इसके तहत बैंकों, कोऑपरेटिव बैंकों और पोस्ट ऑफिस को एक फाइनेंशियल ईयर में तय लिमिट से ज़्यादा कैश निकालने पर टैक्स काटना होता है। इसका मकसद बड़े कैश ट्रांज़ैक्शन को रोकना और ट्रांसपेरेंसी बढ़ाना है। यह नियम उन लोगों, बिज़नेस, कंपनियों और दूसरे टैक्सपेयर्स पर लागू होता है जो ज़्यादा कैश निकालते हैं।

कैश निकालने पर TDS (अप्रैल 2026 से):

FY 2026 - 27 से, TDS नियम ज़्यादातर सेक्शन 194N के तहत जारी रहेंगे, जब तक कि भविष्य के बजट में बदलाव न किया जाए।

Starting 1 April 2026, under the Income Tax Act, 2025 (applicable for FY 2026-27), TDS on cash withdrawals is regulated to promote digital transactions, with rules under Section 393 (or similar, replacing the old 194N).
Generally, a 2% TDS applies on aggregate cash withdrawals exceeding Rs 1 crore annually, and 5% TDS applies if ITRs are not filed for the preceding three years (lower threshold of Rs 20 lakh may apply).

TDS on Cash Withdrawals:

TDS on cash withdrawals is governed by Section 194N of the Income-tax Act. It requires banks, cooperative banks, and post offices to deduct tax when cash withdrawals exceed specified limits in a financial year. The aim is to discourage large cash transactions and improve transparency.
This provision applies to individuals, businesses, companies, and other taxpayers withdrawing large amounts of cash.

Applicability of TDS on Cash Withdrawals (From April 2026):

From FY 2026 - 27, the TDS rules largely continue under Section 194N unless amended by future budgets.

सुप्रीम कोर्ट ने पश्चिम बंगाल में SIR प्रोसेस को फिर से बनाने के लिए आर्टिकल 142 का इस्तेमाल किया, जिससे राज्य सरकार की भूमिका असल में सिर्फ़ एक फ़ैसिलिटेटर की रह गई।

कलकत्ता हाई कोर्ट के चीफ़ जस्टिस को कम से कम तीन साल के अनुभव वाले सिविल जजों को नियुक्त करने का अधिकार दिया गया है। प्रोसेस को तेज़ करने के लिए झारखंड और ओडिशा से भी ज्यूडिशियल अफ़सरों को बुलाया जा सकता है।

भारत के चुनाव आयोग को 28 फरवरी 2026 तक पश्चिम बंगाल की फ़ाइनल वोटर लिस्ट पब्लिश करने का निर्देश दिया गया है।

अनसुलझे “लॉजिकल विसंगतियों/अनमैप्ड” मामलों के लिए एक सप्लीमेंट्री लिस्ट जारी की जा सकती है।

ऐसे वोटरों को अभी भी आर्टिकल 142 के तहत फ़ाइनल लिस्ट का हिस्सा माना जाएगा।

चीफ़ जस्टिस के 22 फरवरी के लेटर के अनुसार, लगभग 80 लाख मामले विसंगतियों वाली कैटेगरी में आते हैं।

250 डिस्ट्रिक्ट और एडिशनल डिस्ट्रिक्ट जज अभी लगभग 50 लाख दावों को देख रहे हैं।

अभी की रफ़्तार से, अकेले बंगाल के जजों को ही लगभग 80 दिन लगेंगे, इसलिए बाहरी मदद ज़रूरी है।

यह ऑर्डर 20 फरवरी 2026 के पहले के निर्देश में बदलाव करता है ताकि समय पर काम पूरा हो सके और चुनाव प्रक्रिया में रुकावट न आए।

संवैधानिक और राजनीतिक मतलब

कोर्ट ने चुनाव आयोग पर अपना भरोसा जताया और SIR को एक संवैधानिक काम माना।

कोर्ट ने पश्चिम बंगाल सरकार के कामकाज पर भरोसा नहीं जताया।

पहली बार, किसी हाई कोर्ट के चीफ़ जस्टिस को इतने बड़े पैमाने पर न्यायिक वेरिफ़िकेशन की देखरेख का काम सौंपा गया है।

अगर फ़ाइनल रोल 28 फरवरी तक पब्लिश नहीं होता है, तो SIR का समय बढ़ाया जा सकता है।

किसी भी देरी से मार्च में होने वाले चुनाव टल सकते हैं।

ज़्यादा देरी से राज्य में राष्ट्रपति शासन लगने की संभावना बढ़ सकती है।

"Supreme Court Order on Bengal SIR Under Article 142 – Key Points" ...

The Supreme Court invoked Article 142 to restructure the SIR process in West Bengal, effectively reducing the State Government’s role to that of a facilitator.

The Chief Justice of the Calcutta High Court has been authorized to appoint civil judges with at least three years’ experience. Judicial officers may also be drawn from Jharkhand and Odisha to expedite the process.

The Election Commission of India has been directed to publish the final electoral roll of West Bengal by 28 February 2026.

A supplementary list may be issued for unresolved “logical discrepancies/unmapped” cases.

Such voters will still be treated as part of the final list under Article 142.

As per the Chief Justice’s letter dated 22 February, around 80 lakh cases fall in the discrepancies category.

250 District and Additional District Judges are currently handling nearly 50 lakh claims.

At the current pace, Bengal judges alone would require about 80 days, hence outside assistance is necessary.

This order modifies the earlier direction dated 20 February 2026 to ensure timely completion and prevent disruption of the election process.

Constitutional and Political Implications

The Court affirmed its confidence in the Election Commission and recognized SIR as a constitutional exercise.

The Court expressed lack of confidence in the functioning of the West Bengal Government.

For the first time, the Chief Justice of a High Court has been centrally tasked with overseeing such large-scale judicial verification.

If the final roll is not published by 28 February, the SIR period may be extended.

Any delay could postpone the scheduled March elections.

A prolonged delay may raise the possibility of President’s Rule in the State.

इंटरप्लीडर सूट कोर्ट में फाइल किया गया एक केस होता है, जब दो या उससे ज़्यादा लोग एक ही संपत्ति या पैसे पर दावा करते हैं, और जिस व्यक्ति के पास वह संपत्ति है, उसे यह नहीं पता होता कि असली मालिक कौन है।

इस तरह का केस इसके तहत फाइल किया जाता है:

कोड ऑफ़ सिविल प्रोसीजर, 1908 – सेक्शन 88
उसी कानून का ऑर्डर ###V (जो प्रोसीजर बताता है)

🔎 समस्या क्या है?

कभी-कभी, एक व्यक्ति के पास पैसा या संपत्ति होती है, लेकिन दो या उससे ज़्यादा लोग कहते हैं कि यह उनकी है।

धारक को इसे रखने में कोई दिलचस्पी नहीं होती।
वह बस यह चाहता है कि कोर्ट यह तय करे कि असली मालिक कौन है।

किसी का पक्ष लेने या गलत व्यक्ति को संपत्ति या पैसे देने का रिस्क लेने के बजाय, वह इंटरप्लीडर सूट फाइल करता है।

✅ ज़रूरी शर्तें (ज़रूरी ज़रूरतें)

एक ही संपत्ति या पैसा
दो या उससे ज़्यादा लोगों का एक ही संपत्ति या कर्ज़ पर दावा होना चाहिए।

कोई व्यक्तिगत रुचि नहीं
केस फाइल करने वाले व्यक्ति को मालिकाना का दावा नहीं करना चाहिए।

तटस्थ स्थिति
उसे किसी एक पक्ष का सपोर्ट नहीं करना चाहिए।
संपत्ति सौंपने के लिए तैयार
उसे कोर्ट में पैसा या संपत्ति जमा करने के लिए तैयार होना चाहिए।

📌 सरल उदाहरण

'अ' के पास ₹1,00,000/- हैं।

'ब' कहता है, “यह पैसा मेरा है।”
'क' भी कहता है, “नहीं, यह मेरा है!”

'अ' कहता है,
“मुझे नहीं पता कि असली मालिक कौन है। मैं तटस्थ हूं। कोर्ट को तय करने दें कि 'ब' को या 'क' को यह मिलना चाहिए।”

इसलिए 'अ' एक इंटरप्लीडर सूट फाइल करता है।

🎯 यह क्यों फाइल किया जाता है?

संपत्ति रखने वाले व्यक्ति को दोहरे दायित्व से बचाने के लिए
- कई केस से बचने के लिए -
- कोर्ट को असली मालिक तय करने देने के लिए।

❌ इंटरप्लीडर सूट कौन फाइल नहीं कर सकता?

कुछ खास रिश्तों में, इस तरह के केस की इजाज़त नहीं है:

एजेंट बनाम प्रिंसिपल
किराएदार बनाम मकान मालिक (कुछ खास हालात में)

क्योंकि ऐसे मामलों में, कानून पहले से ही एक साफ़ रिश्ते को मानता है।

An Interpleader Suit is a case filed in court when two or more people claim the same property or money, and the person holding it does not know who the real owner is.

This type of case is filed under:

Code of Civil Procedure, 1908 – Section 88

Order ###V of the same law (which explains the procedure)

🔎 What Is the Problem?

Sometimes, one person is holding money or property, but two or more people say it belongs to them.

The holder is not interested in keeping it.
He simply wants the court to decide who is the true owner.

Instead of taking sides or risking paying the wrong person, he files an Interpleader Suit.

✅ Essential Conditions (Important Requirements)

Same Property or Money
Two or more people must be claiming the same property or debt.

No Personal Interest
The person filing the case must not claim ownership.

Neutral Position
He must not support any one side.

Ready to Hand Over Property
He must be willing to deposit the money or property in court.

📌 Simple Example

A has ₹1,00,000/-.

B says, “This money is mine.”
C also says, “No, it belongs to me.”

A says,
“I do not know who the real owner is. I am neutral. Let the Court decide whether B or C should get it.”

So A files an Interpleader Suit.

🎯 Why Is It Filed?

To protect the person holding the property from double liability
- To avoid multiple cases -
- To let the court decide the rightful owner

❌ Who Cannot File an Interpleader Suit?

In some special relationships, this type of suit is not allowed:

Agent against Principal
Tenant against Landlord (in certain situations)

Because in such cases, the law already recognizes a clear relationship.

🧠 Remember

An Interpleader Suit is a legal method to say:
“I do not want the property. I just want the court to decide who truly owns it.”
